We’ve been investigating the Wisconsin partisan election review, barriers to voting, and the Jan. 6 insurrection.

Yesterday, we had major developments in each investigation.

Here’s what you should know.
First, our #FOIA lawsuit revealed that the phones of top DOD and Army officials on Jan. 6, 2021 — including acting Defense Sec. Chris Miller and Army Sec. Ryan McCarthy — were wiped and text messages were not preserved.

We asked Attorney General Merrick Garland to investigate the apparent destruction of federal records by DOD and the Army — records that could have shed light on critical open questions about the Jan. 6 attack.
Next, we sued the Election Assistance Commission for communications between select commissioners and known election conspiracy theorists and voting restriction advocates, including EAC advisory board member Cleta Mitchell.

The public needs to know whether Mitchell and her allies have sought to undermine the critical work of the EAC at a time when local election officials are facing increasing harassment and threats of violence, even as they prepare for upcoming elections.
Third, we obtained a memo that shows Michael Gableman—the attorney leading Wisconsin's election review—privately warned against the legally impossible action of decertifying the election just two weeks after he publicly encouraged lawmakers to consider it.

On March 1, Michael Gableman said Wisconsin should take a "hard look" at “decertifying” the 2020 election.

In a March 16 memo we uncovered, Gableman advised Assembly Speaker Robin Vos against decertification.
Regardless of Gableman’s opinion, “decertification” is not legally possible, Wisconsin’s 2020 presidential election results were valid, and no one, including Gableman, has been able to come up with substantive evidence to the contrary.

On Jan. 12, 2021, just six days after the insurrection, we submitted four #FOIA requests to DOD and the Army seeking senior officials’ communications with President Trump, Vice President Pence, and top staff from Jan. 6. After receiving no records, we went to court in March 2021.

Cleta Mitchell was an active participant in Donald Trump’s effort to overturn the 2020 election, and her appointment to advise the EAC was a red flag for potential interference in future elections.
We've already uncovered troubling evidence that the EAC was in contact with people and groups working to restrict voting rights and push false claims of fraud like the Heritage Foundation and the American Legislative Exchange Council.

This year, Arizona state lawmakers put forward a huge number of election-related bills seeking to impose new restrictions on voting. In Feb., @azebtrak listed the ~100 bills submitted in the state Legislature relating to election security & voting rights.

Many of the bills were put forward under the guise of making elections more secure, with some taking direct aim at measures that had facilitated voting and others directly influenced by the “audit.”

Scott Lloyd, an anti-abortion advocate who was then the director of the Office of Refugee Resettlement, attempted to manage the reproductive health of those in his office’s care, including by tracking pregnancies.
