Judge McBurney says "the purpose of today's hearing is to determine when (Giuliani) will be here and in what format," says Giuliani's lawyers are not contesting that he will eventually testify but say he may not travel to Georgia. #gapol
Judge McBurney: "I need clarity. If it turns out that Mr. Giuliani is willfully disregarding the now formal invitation to be here, that's problematic. If that's not the situation then we need to establish when he'll be here and there's lots of ways to make that happen." #gapol
"New York is not close to Atlanta but it is not traveling from Fairbanks," McBurney says, putting cold water on the arguments from Giuliani's lawyer. Wants to get Giuliani to GA "without jeopardizing his recovery" and suggests travel "on train on a bus or Uber or whatever" #gapol
Fulton investigators say they didn't trust Giuliani's doctor's note because it came from an infectious disease expert, not a cardiologist. Adds that the flights to Europe raised alarms.

Giuliani's lawyer says that a bus or train trip to Atlanta is "impractical for any number of reasons." Says it's longer than a 4 hour trip to NH, where Giuliani recently visited. Maintains that Giuliani's health problems are so significant he cannot board a plane. #gapol
MCBURNEY: "I propose we move Mr. Giuliani's appearance date to August 17. It would be here in person. That gives him a week and a day to sort out whether he would travel by private coach or bus or whatever it would be." #gapol
MCBURNEY: "It's like driving to New Hampshire 3 times, so just do it in 3 legs. You know folks in DC, and can stay down there. He can set his own itinerary. I'm confident we could figure out a way for the breakdown that will get him to Atlanta that's not an airplane." #gapol
MCBURNEY: "The 17th is the current game plan."
Tells Giuliani's lawyer that any documents concerning Giuliani's health will be kept under seal.
"Just keep the channels of communication open," McBurney urges both counsels.
