Something huge happened yesterday that the media apparently missed. In Parliament, I had been criticising the Liberal party for their drug policy and urging the Government to allow opioid replacement treatment to help treat people with heroin use problems.

After I finished, it was pointed out to me that only a few hours earlier, @EmmaKealyMP had quietly announced a new policy to do exactly that!

This is a massive development. Allowing this treatment not only helps people who have problems with opioid use, it will help undermine organised crime and prevent petty crime.

First hot take on the issue I've been pressing the most. Vaccine mandates and Section 10 of the Charter of Human Rights, relating to protection against medical procedures without full and free consent. 🧵
For those who have been arguing that the consent process is untainted, not even the Government agrees with you. They have openly admitted that it limits section 10(c) of the Victorian charter of human rights and responsibilities, as I have argued for ages now.
What does this mean? Well, the National Immunisation Handbook clearly outlines the procedures for legally valid consent, which Victoria appears to have admitted to undermining through mandates. Is consent legally valid? I guess the lawyers will have to argue that. Seems dodgy!
It’s time to throw #sandinthegears of systematic segregation. Looks like we are in this for the long haul, even though they have relented on children. We need to raise the transaction cost of compliance. Thread 🧵
Firstly - any business that is strict in enforcement, make it hard for them. Don’t be mean or belligerent. But take your time. Don’t connect your checkin app, make them wait while you scroll through to find your immunisation certificate. Ask them questions. Ensure a queue forms.
Then never go there again. Give them a crap review. Tell your friends how terrible they are. You don’t need to feel guilty. They are collaborators with an inhumane system. They deserve it.
The Australian Immunisation handbook section on obtaining legally valid consent is very well written and forms a sound basis for how to ensure patient consent is valid.

However, we are now in a situation where it could be very reasonably argued that people are being pressured, coerced or manipulated into obtaining medical procedures.

Luckily, in Victoria, we have some protection against this type of Government tyrrany. The human rights charter. It specifically specifies that people shouldn’t be subjected to medical treatment without full and free consent. 3/5
On the legality of public health directions. Many will know that I have been questioning the proportionality and whether they are the least restrictive of rights as required by the Public Health and Wellbeing Act. On 4th May 21, I asked the Attorney General this question

For those that are sworn to protect and uphold the law, this is from the @VicOmbudsman report on housing tower lockdown - one of the very few situations where human rights and legality were investigated in detail. This is from her Foreword in the report. (my highlights) 2/6
Also in the report, there was also this comment in response from DHHS. "mental process" indeed. Despite my every effort, I cannot find anyone outside the Health Department that has admitted reading a charter assessment. 3/6
Some of the reasons I oppose an extension to the emergency powers.

The Government has known from the start that they only had 6 months to use the extraordinary powers. They had time to come up with specific required regulations or solutions which were compatible with a free society.

However, their authoritarian tendency has blinded them to any option other than the stick. They have become totally dependent on it, not even attempting voluntary compliance. They say "this is the only option", but of course it's not.
