#DACA court update: today all the parties in the case by Texas challenging the legality of DACA filed briefs at the 5th Circuit on what the new DACA regulation means for the case. A thread on those briefs & what could come next 🧵:
Nothing has changed today. DACA renewals remain open to folks with current DACA. Folks with DACA can apply for advanced parole. And first-time DACA applications, sadly, can be accepted but not adjudicated. Today was just an important set of court papers being filed. ⚖️📰 /2
This case involves TX (& a handful of other states) who sued to end DACA claiming it is illegal. They won in district court in July 2021, and the case is now up on appeal to the 5th Circuit. The 5th circuit now has all the papers before it & could issue its ruling any day. /3
The Biden administration (DOJ) is defending DACA in this suit, so is @MALDEF (who represents DACA recipients in the case) & the @NewJerseyOAG. There are a range of groups involved in the lawsuit & in today's papers they take a range of positions on what the new reg means. /4
1 question is if the 5th circuit should consider the new reg or send the case back to the district court for that. DOJ & TX say the 5th circuit should not send the case down to the district court. MALDEF and NJ, however, ask for the case to be sent to the district court. /5
So this is the first thing to watch, will the 5th circuit keep the case and decide it or will it send the case back to the district court?

When will we get a decision is another key question. We unfortunately do not know. So, we just have to be ready for a decision any day. /6
Another key question is whether the 5th circuit will address the new reg if it keeps the case. DOJ and TX agree that they have the ability to do so. Though TX thinks the 5th Circuit need not address the new reg if they rule before 10/31. /7
None of the parties dispute that the new regulation is materially identical to the DACA program as created by the 2012 Napolitano memo. So, the needle has moved very little on the parties' underlying arguments as to whether DACA is legal or not. /8
1 argument that is > clear in this DOJ brief is that the Biden admin believes the new reg (& the DACA program) is "severable". They clarify that even if a court finds portions of DACA, such as work authorization, to be unlawful, they would keep the rest of the program. /8
That's the update on the court papers. But this has never been about papers or a program. It's about a million young people who deserve permanent protections. If you a DACA recipient, work w/ one, live next to one, this is the time to make your voice heard. #HomeIsHere

Here's a court update I did NOT expect to give. The 5th circuit issued a couple of orders today on the Remain in Mexico (RMX) case. First they remanded the case to the district court. But then, they didn't really remand it. Why? /1
Because they inexplicably denied the DOJ motion to issue the mandate forthwith (aka right away). The other side (the states of TX & MO) did not even oppose the request for the mandate to issue right away & have the case go immediately back to the district court. /2
TX & MO didn't oppose this request likely because there is no legal reason to justify keeping this zombie injunction in place. 9 justices of the Supreme Court said back in late June that the district court never had the authority to issue the injunction in the first place. /3

That's a wrap on the oral arguments in the Remain in Mexico case today! Here are 5 things you need to know about the case and what happened today. #SafeNotStranded A 🧵
1⃣ Tens of thousands of people have suffered under the cruel Remain In Mexico program. There are huge legal issues at play in this case, but the impact of this case on people seeking safety is the most important outcome.
2⃣ Elections matter. Biden campaigned on ending the RMX program. After careful review, he did so. A single district court judge should not be able to thwart the will of the people. Of course a new president should be able to change the policies of a past president.

The Solicitor General is arguing for the U.S. today. She begins by underscoring the need for Presidents to be able to make policy judgements, not courts. (Subtext: elections matters & courts should not thwart the will of voters). I'll put my takes here on today's argument.
J. Thomas is asking questions about the statutory holding of the lower courts. This is a sleeper issue in the case--the judge below read a portion of the INA in a way that we have never seen it read--to require mandatory detention of asylum seekers. 🤯
J. Sotomayor's zeros in on a central issue in the case. Why do we have such an extensive injunction in place? Why didn't the lower courts just vacate the original memo terminating the RMX program. The aggressive injunction requiring good faith steps to reinstate RMX went too far.

It's been a day in immigration court land. 🤯Within hours of one another we got dueling decisions from 2 different courts in cases involving Title 42, an absurd, cruel policy that has made a mockery of our asylum laws. Here's a 🧵on what happened today. /1
This morning, the DC Circuit ruled in the Huisha Huisha case brought by a courageous group of plaintiffs & attorneys challenging the use of T42 against families. The decision was a win b/c the court said T42 should not be applied to expel families to persecution or torture./2
This merits a bit more explanation. 1st, the DC circuit said that the administration could use the CDC order to expel migrants. But, the court said that power was not unchecked--and migrants could not be expelled to places they would be persecuted or tortured. /3

One lawsuit filed by TX and MO sought to prevent Biden from winding down the heinous “Remain in Mexico” program, which was instituted by Trump and left tens of thousands of asylum seekers marooned in Mexico for months or years with no way to assert their right to asylum. 3/9

I am literally over the moon🌛 to be reading the court order in our Gomez case. After litigation against the Trump and Biden administrations, we finally have a court order requiring the government to issue 9,095 diversity visas that had been held aside for about a year. /1
These are individuals who applied for and won the diversity lottery back in fiscal year 2020…. In other words, they have been waiting about 2 years for this day. Let’s do a rewind to remember how we got here. /2
In June 2020, President Trump signed a sweeping immigration ban blocking most legal immigration to the U.S. This stopped the processing of diversity visas. Every year 55,000 individuals “win” the diversity visa lottery & a chance to come to the U.S. on a green card. /3
