#BREAKING: #AZ federal judge orders in-person hrg TOMORROW in new suit filed by advocacy groups @votolatino@AZRetiredAms seeking to challenge Clean Elections USA & founder Melody Jennings' alleged voter intimidation campaigns.
The suit accuses CEUSA, Jennings & 10 unnamed "supporters" from armed "organized vigilante groups" of conducting "coordinated vigilante intimidation campaign" at ballot drop box locations -- and seeks a temp restraining order to block them from access to ballot drop box sites.
Complaints argues that “organized vigilante groups have already turned away voters" and that their “presence has led to repeated complaints of voter intimidation."
Allegations include that armed vigilantes “gathered at ballot drop boxes in Maricopa County with the express purpose of deterring voters—who Defendants irrationally fear are ‘ballot mules’—from depositing their ballots"
In a scheduling order filed Tuesday, U.S. District Court Judge Michael Liburdi ordered an in-person hearing for the group’s motion on Wednesday afternoon.
“Witnesses shall be available in-person for any testimony,” the judge added.
Jennings posted on Truth Social last week that some of the individuals at the drop boxes were not associated with her group. Efforts by ABC News to reach Jennings for comment were not immediately answered.
UPDATE: Atty for plaintiffs David Fox just filed an update of the status of efforts to serve Clean Elections USA and Jennings per fed judge's order included in court filing setting hearing tmrw. Fox says as of his writing, all attempts to effectuate service were unsuccessful
Attempts by 2 indep companies plaintiffs attys obtained to personally serve Jennings today -- on behalf of both herself & CEUSA -- in Tulsa, OK at what public records indicate is her home address. Neither was able to get someone to answer the door & neighbor did not have info
Additionally, attys w/Davillier Law Group LLC gave plaintiff attys notice Jennings and CEUSA had obtained them as legal counsel late afternoon & filed in court
An atty for plaintiffs then asked if defense counsel "would be willing to accept service on
behalf of both Defendants."
"They responded that they would check with their clients as to that issue. As of the filing of this notice, Plaintiffs have not received confirmation from
counsel whether they will accept service."
Later "[plaintiff atty] served...counsel of record for Defendants via email."
"In light of the foregoing, service is not yet complete," said Fox in the filing.
"However, it is now clear, as a result of counsel’s appearance, that Defendant Jennings and Clean Elections USA have actual notice of these proceedings and the hearing tomorrow," he later added.

Of 130 prospective jurors in the pool, 60 in prospective jury pool remain, 70 were dismissed.
All 18 prospective jurors who were ushered into the jury box for this first panel finished reading all their answers to jury questionnaire before the judge dismissed court for today.
A woman from prospective jury panel of 18 was excused bc 1 of her answers to jury questionnaire. she answered “yes” to question 29 on the questionnaire; Asked if 29 was yes by Judge Merchan, he then asked her to step forward to speak with counsel. she was then dismissed.
She told reporters outside court room question 29 had to do with biases against Trump that would not allow her to be an impartial juror in the case.
Trump Payroll attorney Michael Van Der Veen told me “there was a lot of bias” when I asked if dismissed jurors from the panel had connections or biases against Trump, Trump Org, Weisselbergs, etc.
He also told me among those prospective jurors dismissed were people who had connections to the organization, people with connections to the grammar school Columbia Prep three who knew prosecution.
Van Der Deen said they’d like jury selection to conclude on Friday but tbd on how realistic that is.

Out of a group of 130 prospective jurors, nearly 50 raised their hand to go back to speak with the judge, prosecution and defense outside the court room [no press access so we can’t hear]
to talk over any issues they have named by the judge that would exclude them from serving, and bringing the jury questionnaire we haven’t seen yet.
Reasons for jurors seeking to be excused could scheduling conflicts and the normal rung of issues that jurors seek to be excused from. Or Bias and connections to or opinions on a list of names that would impede them from serving as a juror - or judge of the facts.
Inside the court room on the first day of the Trump Organization’s criminal trial, New York state Judge Juan Manuel Merchan decided jurors will be told to expect the trial to last 5-6 weeks.
Prosecutors said they expect their case to last 10 court day.
Trump Org attys said their case length may change based on which of prosecution’s witnesses end up taking the stand, and who among the list are not called -- but said their only planned is their expert witness, which would not take more than a day.
