THREAD: For those with misplaced anger that Pence is “considering” testifying: he has not been subpoenaed. You want to get voluntary testimony first. If they say no, then subpoena. Then they don’t have a choice. Pence is not a target in this investigation. Trump is. 1/
Journalists (should) report news as soon as they get it. They don’t - nor should they - sit on a story until it’s dramatic enough for you. Step one is “considering.” Step 2 is a subpoena. The last thing you want is a recalcitrant witness that could help your case. 2/

You've heard me say that WE are the Mueller's we've been waiting for. That we must vote in numbers too big to manipulate. WE elected Biden, who appointed Garland, who appointed Special Counsel. The work is theirs, but the victory is ours. 2/
As many of you know, this is also personal to me. I started a podcast about a special counsel probe. Donald didn't like that I was wrecking his narrative so he fired me from my government job. That freed me up from the Hatch act and we raised $500K to elect Biden and harris. 3/
11th circuit opens saying they've read all the briefings and asks the parties to present their arguments quickly. The government is up first and gives background. No equitable jurisdiction, plaintiff hasn't demonstrated likelihood of success, and can't show irreparable harm.
The government already cites the 5th circuit precedent invoked by the 11th circuit (a hint to Chapman and the first Richey factor - a callous disregard for constitutional rights). 2/
Judge Pryor asks Joshi (government) if there's ever been a case where anyone got their shit back pre-indictment without a callous disregard factor). Judge asks if the first Richey factor is Dispositive. Joshi says that's his view, and other courts show its the most important. 3/
THREAD: CAN THE GOP DEFUND THE SPECIAL COUNSEL? I’m so glad you asked. Lots of members like @RepMTG have floated this threat. I happen to know from the PREVIOUS special counsel (which I may or may not have covered extensively) that the GOP can’t defund him. 1/
Anyone who listened to Mueller, She Wrote knows that the Special Counsel’s Office is funded from a permanent Treasury Dept account that isn’t subject to the annual appropriations process, and it’s the Attorney General that approves that budget. 2/

THREAD: THE DIFFERENCES BETWEEN MUELLER & JACK SMITH. So there's been a lot of reaction to the appointment of Special Counsel Jack Smith - both positive & negative - along with comparisons to all the bad things about the Mueller investigation. Let me outline the differences. 1/
First, Jack Smith won't be working under the constant threat of being fired by a hostile AG and a dipshit president. That sword of Damocles constantly forced Mueller to walk a fine line, and that won't be the case in this Special Counsel probe. 2/
Second, there's no Rod Rosenstein - a cowardly wisp of a man - to narrow the scope of this probe. Rod clipped the Mueller probe to a paper-thin investigation, and then promised to "land the plane" based on his curtailing of the breadth of Mueller's work. 3/

I have been calling for a special counsel for a while for multiple reasons - but most importantly - TRANSPARENCY. A special counsel must say what they’re investigating, and they have to report to congress any prosecutorial decisions OR declination decisions. 2/
That means if they decide not to prosecute, they have to say why not. If it were just the DoJ, they wouldn’t be required to explain why they didn’t charge him, or even that they’ve decided not to. 3/
