NY Senate Bill 2860 expands coverage beyond correctional facilities. In this version, incarcerated males can opt into any type of facility. This, presumably, includes forensic mental health facilities. So now we are housing mentally ill incarcerated men w/ mentally ill women. 2/
NY Senate Bill 2860 also adds this new challenge for prison officials: They have 2 days to make a decision. One would hope this process would involve, at a minimum, reviewing criminal history, prior incarceration records, psych evals; conducting interviews. There is no way. 3/
This 2-day deadline to reach a decision, w a high burden using an unclear standard and the right of someone denied to file litigation and obtain monetary damages and attorney fees (the latter discussed re Assembly Bill linked above in this thread) = recipe for only approving. 4/

NY State Assembly has reintroduced Bill from last legislative session to allow males to opt into women's prison based on self-declared "gender identity" only this time…it's even worse. Let’s walk through some low lights. 1/
The key provision of Bill introduced yesterday in NY State legislature remains the same: inmates are to be PRESUMPTIVELY housed in correctional facility which most closely aligns with their “gender identity” regardless of their sex. 2/
Eligibility for such cross-sex housing under Bill pending in NY State legislature includes:
•Gender identity different than assigned sex at birth
•Diagnosis of gender dysphoria
•Self-identifies as transgender, gender nonconforming, nonbinary or intersex 3/

As more & more males have been placed in women's prisons, predictably, there have been more reports of rapes, assaults, pregnancies, threats.

A serial killer of women and rapist, who previously murdered two girlfriends has now been accused of dismembering a THIRD woman following his most recent release from prison. He is now being held awaiting trial at the women's unit on Rikers Island, New York City's jail. 3/
SOME GOOD NEWS! A FEDERAL INJUNCTION HAS BEEN ISSUED. @POTUS's first day in office, he issued EO 13988. This directed fed agencies to revisit their rules & to reinterpret laws on "sex discrimination" to include "gender identity." Multiple agencies issued such guidance in 2021. 1/
Two examples of federal agencies acting on EO 13988: Dept of Education issued guidance that students are entitled to use school bathroom which aligns with their "gender identity." EEOC (which deals with discrimination in the workplace) issued similar guidance for employees. 2/
As described in the injunction order re Dept of Ed and EEOC, the agencies overstated what SCOTUS's decision in Bostock required in terms of "gender identity" being covered under the protected characteristic "sex" 3/
