Okay #lawtwitter, I feel stupid here, but I'm going to ask anyway.

There's a district in Virginia wherein the commonwealth attorney's office is refusing to get involved in any misdemeanor prosecutions, leaving the police to also prosecute.

How is this not UPL???
Without a prosecutor, there's literally no such thing as a "fair and impartial finder of fact," since the JUDGE has to push to prosecute and the POLICE act as the prosecutor.

How the Hell does that work!?
Is Virginia seriously just going "Fuck fair and impartial trials, let's just turn this into a prison mill"???
Oh, okay, and the police DON'T EVEN HAVE TO PROVIDE BRADY MATERIAL!?!?!?

Also, I know folks like @Nymdok (and others) who are very much "read the law on its face" (which is normally a very reasonable thing to do).

How, then, Virginia, can anyone be reasonably expected to read and comply with the law when it is literally negated in court?
VA Code 19.2-258: "In all cases of a misdemeanor [...] If the accused plead not guilty, in person or by his counsel, the court, [...] with the concurrence of the accused and the attorney for the Commonwealth, may hear and determine the case[.]"
Yet in "Commonwealth v. Wilkerson," the so-called "Judge" Gary A. Mills states plainly that no attorney for the Commonwealth is required to hear and determine the case.

Completely opposite of what the written law says.

Ho-lee shit. I just learned about "Commonwealth v. Wilkerson" today and it is a *doozy*.

"Honorable" Gary A. Mills, Judge in the Circuit Court of the City of Newport News, VA - You have your head so far up your own ass I'd be shocked if you can see daylight.
"Second, law enforcement agencies certainly understand the repercussions of not disclosing exculpatory evidence. While not receiving the same rigorous legal study as a Commonwealth's Attorney, law enforcement is educated on Brady and its progeny during their training."
So you've never met a cop, then, Mr. Mills? Because I can promise you that very few of them understand what the hell Brady is, let alone how it actually works in any real cases.

I use 24 hour time. Yes, that's 3:10 AM. That particular conversation started at 1:30 AM.

This is my life now. I'm awake all day from ~6 AM to midnight, roughly, and then get woken up in the six hours of sleep I try to block out.

So yes. I'm weird and lewd and crude on the bird site. I post at random times about random bullshit. Why? Because I am working a VAST MAJORITY OF MY FUCKING DAY.

I don't have "downtime," I have "I'm doing two things at once."
"But you play Final Fantasy 14!"

Yes. I do. You know WHY? Because I can stop playing it and just *look away* and work on shit and it's a good escape for 5-15 minutes at a time before going back to doing more work.

I'm literally never doing something without work next to me too.
