Senior Counsel Kapil Sibal represents Tamil Nadu Government. Says ordinance has not come to force yet. Says, it will come to force on a date notified by the Government.
Mr. Sundaram says the present cases can be kept pending and a direction be given to officials to not take punitive action for a week after the ordinance comes into force so that the cases can be heard thereafter. Mr. Sibal objects & says there can't be a preemptive order.
Hearing commences. Advocate Krishna Srinivasan, representing CMC, informs Madras High Court of the action taken by the management with respect to the incident. Says anti ragging committee inquired about it & suspended seven students based on preliminary report. @THChennai
He also says FIR has been booked and police is seized of the matter now. Further, referring to the prospectus, he says college management maintains zero tolerance towards ragging.
ACJ says if ragging is happening even in a highly reputed institution such as CMC, then it may become contagious and spread to other institutions too. Mr. Srinivasan says it was an unfortunate incident but the management had sprung into action and taken prompt decisions overnight
Justice GK Ilanthiraiyan of Madras HC begins hearing a contempt of court petition filed by RSS Tiruvallur joint secretary R Karthikeyan against the police for denying permission to the route march on October 2 @THChennai
Senior Counsel S Prabakaran, representing the contempt petitioner, says the judge had on September 22 issued a positive direction to the police to grant permission for the march and yet the police rejected it.
Mr. Prabakaran argues that police cannot sit over the orders passed by the court and invent new reasons to reject permission despite a specific judicial order to grant permission. He says the police are bound to obey court orders.
An association of hotels & restaurants in Chennai has approached Madras HC claiming that a designated officer, under Food Safety & Standards Act, has no authority to go into kitchens with television crew for inspection. Says, the officer in Chennai is a publicity freak @THChennai
Senior Counsel PS Raman, representing the association, says the officer can inspect any restaurant without calling the media in advance. Judge says, the request appears to be reasonable.
Judge says officer can take a private cameraman with him but it may not be right to take television crews along with him to the kitchen even before food samples are taken and tested to prove culpability.
