#MadrasHighCourt extends life of interim orders until June 30, 2021, in view of the present #COVID19 situation.

Interim orders subsisting on April 30 stand extended till June 30 unless vacated/modified/unless specifically dealt with by judicial order to the contrary.
Orders of eviction, dispossession, demolition that have not been executed till date shall remain in abeyance till June 30, 2021, unless the stay is expressly vacated or the order of stay expressly modified by any judicial order passed by an appropriate forum.

All orders passed by criminal courts - including bail, parole, anticipatory bail orders for a limited period & likely to expire on or before June 30, shall stand extended till June 30 (subject to any orders passed to deal with any abuse of order)

In a status report filed yesterday by Principal Secretary, Health, the State has informed (1/n):

- 29,272 active COVID cases as on May 11, 2021;
- Due to inadequate #Remdesivir allotment, TN is drawing it from reserve stocks;


- TN has sought 20,000 #Remdesivir vials a day; the current allotment is 7,000 vials a day “without an assured allocation and supply schedule.”

- Daily consumption of Oxygen is around 470 MT; expected to increase to around 850 MT, if cases increase.

AG informs that measures concerning the control of media crowds at counting booths are also detailed in the status report.

Guidelines including media to carry -ve RTPCR report (taken 72 hours before) or should have taken at least one vaccine shot.

Court asks how guidelines will be implemented: Because you know, there is a scramble. With the proliferation of channels... there will be crowds and you will have to control them.

In response to EC counsel submitting that measures have been put in place, #MadrasHighCourt CJ orally remarks: "Were you on another planet when political rallies were being held?"

EC Counsel assures that the best steps being are taken and says an affidavit can be filed.

#MadrasHighCourt Chief Justice Bench hears suo motu case concerning COVID-19 situation in TN including on aspects of Remdesivir, oxygen supply, ventilators and COVID-19 vaccination.

CJ Banerjee refers to article which states that Remdesivir is diverted, another article saying that TN was not consulted when Oxygen was diverted from the State.
CJ Banerjee says that Court is not trying to add to the confusion, but there should be empowered authorities at the secretary or undersecretary level without reference to anyone in exigences.

Will also be open to state to consider administering #COVID19 vaccine to persons with disability above 18 yrs as indicated in 1st schedule of Rights of Persons with Disabilities Act, 2016

#Breaking: #MadrasHighCourt opines that it appears that the Tamil Nadu govt may not have followed applicable UGC guidelines in cancelling college arrear exams in August 2020 amid #COVID19; suggests that State come up with a Plan B after consulting the UGC.
"Though the relevant notification (Aug 26, 2020) referred to evaluation being carried out on the basis of the guidelines issued by the UGC or AICTE, it appears that AICTE did not agree to the proposal and the UGC guidelines may not have been followed at all."

- use of banned bull bars fitted on cars, especially of VIPs, VVIPs
- fitting of rearview mirrors inside autos instead of outside as required legally
- pasting stickers hindering driver vision
- inappropriate pasting of Bar Council stickers
Madras HC also notes that it has raised the issue keeping rearview mirrors inside autorickshaws repeatedly. As transport authorities and police have not enforced the law, court may also initiate contempt action, it notes.

During the hearing today, AG Vijay Narayan informed Madras HC that the State has decided to reject the application for the conduct of the Vel Yatra in the public interest in view of the COVID-19 Govt orders as well as the threat of a law and order situation
