🧵 I’m seeing some confusion about what happens now that John Tory has announced he will resign.
1. Tory hasn’t resigned yet. Once he does, Deputy Mayor McKelvie becomes the Head of Council and assumes all of the powers of mayor until a new mayor is elected. #topoli
2. Once a member resigns, Council must declare their seat vacant at their next meeting, per s. 207 of the City of Toronto Act. This could happen as soon as Wednesday but depends on the timing of Tory’s resignation.
3. Once the Toronto Mayor’s office is vacant, the new provisions for filling the vacancy from Bill 3 (strong mayor powers) apply.
Notably different from the past: Council can’t choose to fill a vacancy through an appointment. Bill 3 requires that a by-election be held.
4. Once the seat is vacant, Council has 60 days to adopt a by-law regarding the by-election. This by-law will specify key elements of the election, such as voting day, the first and last days for nominations, etc.
The election cannot officially begin until nominations open.
5. What is not clear based on the recent Bill 3 amendments is the deadline for starting the election or holding the vote. We likely won’t know what City staff proposes for election timing until the by-election by-law appears on a Council agenda.
6. Finally, this week council reinstated the requirement for candidates to disclose their election expense receipts. This is vital for election accountability and it turns out it was very important council took that step when they did (too bad they exempted 2022). /END
As a former vice-chair of @torontolibrary's board, this statement from the City Librarian is disappointing and a poor interpretation of the Community and Event Space Rental Policy that will harm trans people.
The policy is clear that even promoting "contempt" based on 1/
one of several grounds, including gender identity, can be cause for canceling a room booking.
The City Librarian contends that to cancel a room booking discrimination, contempt or hatred would need to be the express purpose of the booking or a listed speaker would need to be 2/
charged with or convicted of hate speech under the Criminal Code.
