This is not an SEC case. The SEC is not arguing that these emojis mean anything. I included a link to the decision and a screenshot of the statement so everyone could decide what this means. In my humble opinion, I think the judge painted with too broad a brush.
The fact that a judge overstates something in a decision is no reason to insult the judge or conclude the apocalypse is nigh. It is not the end of free speech. This is a decision showing that emojis used by these folks meant an expectation of profit. All is not lost folks.
