It's always worth digging into the depths of a company's accounts. Here, from the September 2022 filing, is the solution to the mystery of #Silvergate's repayment of FHLB advances. FHLB advances in December 2022 totalled $4.3bn, far above Silvergate's maximum borrowing capacity.
Why did FHLB demand repayment of the entire borrowing, not just the overlimit amount? Couple of possible reasons. By Dec 2022, the value of Silvergate's asset base had reduced significantly due to fire sales and asset reclassification. And also, this is a covenant breach.
btw the FHLB appears to impose mammoth haircuts on collateral. Silvergate's reported FHLB borrowing as at 30 September 2022 was $700m.
What I want to know is, who at FHLB approved Silvergate drawing $3.6m in less than three months against insufficient collateral, and why?
Though presumably Silvergate did stump up additional collateral. The maximum borrowing of $2.3bn ($700m outstanding + $1.6bn unused capacity) in the September filing is against pre-positioned collateral of $2.7bn.
The December accounts also suggest total FHLB borrowing was around 29% of total assets, which is well under the 35% maximum. But the December accounts are going to be restated. So did Silvergate actually breach the 35% limit?

What else do the weeds of Silvergate's filings tell us? They tell a story of a bank that put all its eggs into a digital basket, believing that providing non-interest-bearing deposit services to crypto platforms and investing in low-risk assets would be a nice little earner.
Silvergate was actually pivoting away from real estate lending.
And yet Silvergate's principal source of short-term funding was FHLB. Why on earth Alan Lane thought it was remotely reasonable to tap FHLB funds to provide liquidity for its crypto-related services, including SEN leveraged loans, is a mystery.
The protected characteristics under EA2010 are:
age; disability; gender reassigment; marriage and civil partnership; pregnancy and maternity; race; religion or belief; sex; sexual orientation. equalityhumanrights.com/en/equality-ac…
Gender-critical beliefs are protected under the general protected characteristic of religion or belief. They do not have their own protected characteristic. Belief in what GCs call "gender ideology" is equally protected.
Nonsensical to say only trans people with GRCs have their legal sex shown on a DBS check and everyone else has their sex at birth shown. For anyone who isn't trans with GRC, the sex at birth IS the legal sex. So everyone has their legal sex shown on a DBS check.
What you are actually doing, @joannaccherry, is using this issue to undermine the existing GRA and chip away at the legal rights of trans people.
I say this because it would not only be sex offenders whose previous names and gender would have to be disclosed on a DBS check, @joannaccherry. It would also be law-abiding trans people, men as well as women, who simply want to do a perfectly normal job.
My piece opposing #WASPI campaign's compensation claim. Imho it is wrong to transfer money indiscriminately from young ppl to the richest generation in history. Instead, we shd improve working-age benefits and increase funding of health and social care. coppolacomment.com/2023/02/waspi-…
I think #WASPI campaign's legal action is likely to fail. But even if it succeeds, the PHSO can't make an award large enough to compensate women for the loss of pensions from 60. And the Govt doesn't have to pay what the PHSO recommends anyway. coppolacomment.com/2023/02/waspi-…
The #WASPI campaign is telling women that if they contribute a few ££ now, they will receive £thousands in compensation. But they won't. No way are they ever going to get that sort of payout. coppolacomment.com/2023/02/waspi-…
Forstater says schools should refuse to affirm students' social transitions. Her reason for recommending this is that this might prevent them proceeding to medical transition. This goes far beyond schools' responsibilities towards their students...
Furthermore, if this interference in a child's personal development caused distress leading to poor educational performance, the school would actually be failing in its statutory responsibilities towards that child.
I hate politics. Give me a nice financial fraud any day. Much less complicated.
and as for lawyers who behave like crypto bros... "yOu dOn'T unDeRStaNd tHe tEcH" and "yoU dOn't UnDErStAnD tHe LaW" are remarkably similar, wouldn't you say?
I've generally found other professions to be less aggressively defensive, though I do recall a certain accountant telling me I couldn't read corporate accounts and didn't know what group consolidation was.
