An “emergency” ex-parte order was granted on Monday morning without a hearing. It has removed my scheduled court date to determine the damages owed to me by Kaiser Permanente.

I was provided the ex-parte application documents at 4:03pm on Sunday (the day before).

Despite being provided the moving papers by Kaiser’s attorneys at 4:03pm on a Sunday, I managed to type up my opposition, print it out, drive up to the courthouse, and place it in the after-hours drop box at approximately 9:30pm Sunday night.

At 10:30am yesterday morning, Kaiser’s “emergency” ex-parte request was granted without a hearing.

I was at the courthouse, clean shaven and wearing my best suit, at 8am. A bailiff told me to leave. He later told me a second time to leave.

I took the hint and left.

Then Kaiser’s requested “emergency” ex-parte order was summarily granted. This is not justice.

This is a heart-wrenching gut punch. I have suffered this trauma for two years and two months. I was 14 days away from finally getting my day in court and be heard.

Now, I am being made to continue suffering even more intensely for at least 3.5 more months.

This is not right.

And that’s a “best case” scenario.
If the bullies get their way, and law truly doesn’t matter at all anymore, I will be stuck in protracted litigation for an unknowable and potentially unlimited amount of time.

This is not right.

I fully cooperated with the letter shown below in 2018. I remain a constituent and I am now in desperate need of assistance.

The Sonoma Superior Court is denying me due process and equal treatment under the law.

Kaiser’s ex parte “Legal Argument”:

My timely opposition:

Kaiser’s attorneys are essentially arguing for a ‘Unitary Judicial Theory’— wherein a judge can issue any ruling whatsoever without relying on anything other than their own inherent power to rule as they see fit.
They are arguing for monarchy of the bench.

Kaiser’s attorneys cite this:

“[c]ourts have inherent equity, supervisory, and administrative powers as well as inherent power to control litigation before them. Inherent powers of the court are derived from the state constitution and are not confined by or dependent on statute”

That’s not “good reason”.
That’s an attempt to convince a judge to act as if a king.

This is the lawsuit resulting from me being kidnapped and tortured.
Does the corruption and rot ever end?

Additional deficiencies to note on Kaiser’s “emergency” request:

- incorrect date stated for filing of my complaint.

- Proof of Service is not signed nor attested to by Kaiser’s attorney.

Yet their “emergency” request sailed through with no problems whatsoever and no hearing.
