There is no statutory requirement under NSA to produce a detenue before a magistrate as it is a detention and not an arrest.
When a person is dtained under NSA, authority has to communicate to detenue within 5 days & in exceptional circumstances 15 days from dtn date the grounds on which the order hasbeen made. So there is no need for @CPJalandhar or @PunjabPoliceInd to inform the public right now
This means that Amritpal, if he is detained under NSA, will get to know the grounds of detention in writing after 5 days. So, there is neither a need to inform the media about the detention nor make the NSA order public right now.
The government as per NSA, is under no obligation to disclose facts which it considers to be against the public interest to disclose. @PunjabGovtIndia
Section 3 of the NSA speaks about the power to make orders detaining certain persons. It provides for a 3-month detention in the first instance and a repeat 3-month detention.
Maximum period for which a person may be detained under NSA in pursuance of any detention order which has been confirmed under section 12 shall be 12 months from the date of detention. @DGPPunjabPolice
