1/Due to the inability to enter the oPt, I turned my planned field visit into a 75day long series of consultations, including individual & town-hall meetings. I also conducted "virtual tours" with Palestinian & Israeli NGOs. My main observations: are here: ohchr.org/sites/default/…
2/Draconian regulations & law enforcement operations in the oPt often lead to arbitrary arrest&detention, violations of fair trial & ill-treatment.While most of these violations can be attributed to Israeli authorities, Palestinian authorities also bear significant responsibility
3/Over 55yrs,Israel has established what can be described as an open-air prison in the oPt, exemplified by the 17yrs long Gaza blockade. The limitations on rights&freedoms are not confined to traditional prison cells, & are enforced through spatial,bureaucratic & digital controls
4/ Israel's large-scale arrests & detentions of Palestinians can be linked first and foremost to the heavy presence of illegal settlers; available data show that 90% of arrests in the West Bank take place near (within 1km from) colonies.
5/ Refugee camps are prime targets of collective punishment measures such as curfews, home demolitions, movement restrictions, and frequent military incursions. In 2022 refugee camps in West Bank/Jerusalem suffered more than 800 military incursions out of a total 2000 in the area
6/ NIGHT incursions & home searches are deliberately frequent: in 2022 one Palestinian village registered 16 incursions over one month. According to Israeli sources, this is one way for soldiers to “make their presence felt” and “ensure that Palestinians keep their heads down”.
7/Carceral violence & abuses reported under the
Palestinian Authority in the West Bank, generally target political opponents, often among the youth & in/around university circles. This aggravates the stifling control Palestinians experience under occupation.
8/Among the violations attributable to the de facto authorities in the Gaza Strip, I found the denial of fair trial and ill-treatment reportedly high in Gaza detention centers. Among others, I am investigating the case of two Israelis detained by the de facto authorities.
9/ In the oPt, the imprisonment experience trespasses life: I was astonished to learn that Israeli authorities withhold the bodies of 125 Palestinians who either died in prison or during a "confrontation". Gaza authorities also withhold the bodies of two deceased Israelis.
10/Among the aberrations I regularly observe, none is so abominable as the treatment of Palestinian children: arrested at young age, sentenced from the age of 12, often subjected to solitary confinement and ill-treatment. The term "unchilding" barely describes their plight.
11/ More can be found in the end of (non)country visit statement (link attached above), and in the full report that I am still writing, to be presented to the #HRC this year.

At a moment of acute tensions in the occupied Palestinian territory (oPt) and a growing need for international protection, it is very concerning that @EU_Commission does not address the magnitude of evidence substantiating the existence of a regime of Apartheid in the oPt 🧵 1/13
@EU_Commission Instead, @EU_Commission hides behind a dogmatic position “it is not appropriate to use the term apartheid in connection with the State of Israel”. It said so in answers by EU High Rep @JosepBorrellF to questions in the European Parliament /2
@EU_Commission@JosepBorrellF I’m also alarmed that @EU_Commission dismisses the validity of the Apartheid framework by associating @amnesty‘s ground-breaking report "Israel’s Apartheid Against Palestinians" with antisemitism – yet again, by invoking the IHRA definition of antisemitism /3
1/I am still waiting for an official response from the Israeli authorities regarding my entry into occupied Palestine in 2022. I have been waiting for a month now since my support team was told I would be granted entry.
2/Anticipating delay, I started meeting with authorities & NGOs in Amman. Not all could come. The journey from West Bank/Jerusalem can be long, uncertain & onerous. People from Gaza didn't even consider to afford it, through Egypt into Jordan.
No SR shoul be so inaccessible.
3/Unable to access the oPt, I am continuing to have my meetings remotely with:
-former detainees, often children;
-families whose beloved ones were taken for years, alive & even dead;
-communities encircled by colonies, walls, fences, checkpoints, roadblocks, settler violence.
My belated thanks @kschnurbein. While I warmly welcome your embrace of “human rights for all”, I don't see steps so far by @EU_Commission to counter the misuse of the IHRA definition of antisemitism (WDA), which “must be prevented” as you said before🧵1/5
@kschnurbein@EU_Commission Given IHRA's focus on Israel, Palestinians should also be treated as being concerned. I invite you to carefully consider the growing list of incidents showing how the IHRA WDA is used to chill free speech and activism in defence of Palestinian rights 👇🏼/2
@kschnurbein@EU_Commission In particular, I’m alarmed by concerns that @EU_Commission may condition funding on compliance with the IHRA WDA, and/or promote its legal status. Further questions arise about the future status of the IHRA WDA in the EU’s Digital Services Act (DSA) /3
Thank you for your response, dear @kschnurbein. I took a few days to carefully consider it, please find my answers below. I’m happy to discuss further in person.
🧵
@kschnurbein I agree that evidence based policy making is essential. For evidence justifying the EU’s support for the IHRA working definition of antisemitism (WDA), you refer to the 2018 FRA survey. However, in general, policy making based on one piece and sort of evidence risks being flawed.
@kschnurbein Responding to you, experts have raised methodological concerns about the 2018 FRA survey, e.g.: focus on Israel-related antisemitism, underrepresentation of younger respondents and Jews unaffiliated with organizations, sampling bias due to self-selection.
I deplore the senseless loss of life that continues to plague the region: in 2022 alone so far, 190 Pal. & 24 Isr. were killed. Heartfelt condolences to the affected families.
To western states, who seem incapable to read & name what is happening in the region: please, wake up🧵
The current reality is the result of the toxic combination of protracted illegality & impunity: of tolerance of & acquiescence to Israel's domination of the occupied population,on lands usurped through force,discriminatory/abusive policies & pillaging of resources(yes, apartheid)
The law of self-determination makes the very existence of such an occupation an "unlawful use of force" & can be seen as an act of aggression.
This triggers consequences under the UN Charter, the law of State responsibility & int'l criminal law (A/77/356, para 72).
