Watch Live on @CMACTV
Council meeting begins at 9:04 with all Council Members present.Invocation by Wesley United Methodist Pastor Rev. Robin Mathews-Johnson. ImageImage
Emergency Dispatcher's Appreciation Week Sponsored by Maxwell and Karbassi. Karbassi:Thin yellow line on flag is for Dispatchers. We were able to raise their wages. I had to call 911 this week due to my father falling. I want to thank the dispatchers for their work.Maxwell: I ImageImageImage
stop by dispatch every year and they are always busy. 1 million calls a year! the center looks like a casino with no windows. They are the hardest working staff. We are working on a new center for them. @MayorJerryDyer As PD Chief I saw all the work the dispatchers do. Officers
rely on getting the most accurate info from the dispatchers.@BalderramaPaco Thank you for recognizing my folks. Officers at least get closures with calls but dispatchers typically don't. 24/365 operation. ImageImage
Proclamation for "National Crime Victims' Rights Week" Sponsored by Maxwell. Criminal Justice system works well but mainly focused on the criminal but the victim is often has no place to go. By calling James Lowen (?) Crime Victim Center it is a the worst day for the victim. ImageImage
Proclamation for "National Donate Life Month" Sponsored by Bredefeld @GarryBredefeld Waiting list for needed organs. @MayorJerryDyer Everyone knows someone who is waiting for a needed organ. pink dot on Driver's License gets you on that list. Jaclyn Mansanito:People wait on the ImageImageImage
kindness of others. One such person Garcia made the decision to donate her son Mickey's organs. Flora graph portrait is made. Mickey's mother tells about her son (in spanish). 4 of his organs were donated including his cornea and tissues. ImageImage
Proclamation "Honoring Fresno Poet Laureate Joseph Rios" Sponsored by Office of the Mayor and City Manager Mayor:Fresno is rich in poetry. You would think he is a football player but is a gentle giant! Fresno Art Council Lilia Chavez:Poetry and arts in general are Image
important and Fresno is known nationally for poetry. Rios:reads a poem for this occasion. ImageImage
@kmkarbassi Tour of Veterans Blvd. It is a really moving. I also got to tour Dispatch. Fresno Grizzlies is also in town v San Jose Giants! Our California Poet Laureate was at the Fig Garden Library reopening. @MiguelArias_D3 I am having meetings with neighbors regarding the Image
upcoming budgets. Tower Market event. I need an update on Hardy's Theater. We are also adding another mobile shower but we need a better partner with County. Dickey Youth bridge collapsed. @LuisCha70215912 Thanks CBO's cleaning neighborhoods. Also a new trail cleanup in Calwa. Image
@GarryBredefeld We are having a clean up event at Woodward Park this Saturday. @esparza_nelson Broadband For All event at City College. Jackson Elementary Event. May 13 Playsmart on Huntington Blvd. And directed to Mayor:I want Budget Binder in our hands May 15th! @AnnalisaPerea Image
Proud of the progress on Veterans Blvd! My first town hall west of 99 occurred. Thank my staff for helping getting that done! Also first Tower Farmers Market opens today! Street will start closing this afternoon.@Maxwell4Fresno First Easter event at Einstein Park. 600 eggs went
in 3 minutes! Also On the Same Page initiative which is to put up a Neighborhood Library in every neighborhood in District 4. May 18 we hope to have collect 1000 books to place in the library.
@MayorJerryDyer Encampments on Freeway event with other cities to hear what Fresno had done. 1500 volunteers for Great America Clean Up this Saturday. Esparza:I hope to get budget in your hands by May 18. City Manager @gawhitefresno :Employee Recognition event occurred. Image
Dinkey Creek Bridge is actually owned by Forest Service and we are in talks with them about replacing it. Church Ave closure due to High Speed Rail and we are doing what we can to lessen the impact. We are working with customers who are behind on payments. Image
4-A Bill (For Introduction) - Amending Chapter 9, Article 26 of the Fresno Municipal Code to add Section 9-2610, "Sideshows, Street Races, and Reckless Driving Exhibitions," prohibiting the knowing participation as a driver, passenger, or spectator in sideshows, street races, or
reckless driving exhibitions. Bredefeld:there will be a $1000 fine and/or 6 months in jail. This just gives the police another tool. @AnnalisaPerea It has been a larger issue in my district as we push it out of inner city to the edges. This reminds me of the illegal fireworks
where not only the one who shot the illegal fireworks but those who hosted or owned the property. Bredefeld:We want citizens to call the police when these speed racers are gathering. @BalderramaPaco We want to be proactive with this law change. We want to send a message that this
is not tolerated as well as let those from Bay Area or Los Angeles this won't happen in Fresno. @LuisCha70215912 All of us have to deal with this. Gang injunctions but are we criminalizing the witnesses or passengers in the vehicle. We need to be cautious. I don't want to get in-
to an ACLU case where we are not letting people assemble. How do we proceed with this? Also tow truck operators who wait for these cars to break:are they targeted by police too? @BalderramaPaco Freedoms are important but we will be going after those actively participating.
We will ask people to disperse and give people the option to leave first. But many are trespassing and this gives us another tool. Chavez:If someone pulls up to me and revs their engine. Am I know "participating"? @BalderramaPaco This does not apply to that. Evidence of prior act
will be treated case by case. They are more for those who continue to create dangerous issues over and over. Chavez: i don't want Officers to have to use their discretion on who they arrest or not as a spectator.City Attorney Janz: We will consider prior acts. An element Image
of intent and a willing participant of the event. A witness would not be the target. @kmkarbassi If someone throws a beer bottle not already a crime? How much did PD work on this? Chief:It would be assault. And it was given to us this week. Karbassi:We have had vehicle deaths are
preventable. We have also impounded racing vehicles for a month and 1000s in fines.New State laws are on board too.I needed more than 48 hours to review this. Also people are racing red lights. We need to crack down on this. I want to postpone this for a few weeks
so I can review this better as well as toughen it. Esparza seconds this. (postpone until more comments) @MiguelArias_D3 I still have PTSD from the last time we were challenged by ACLU in people watching encampments being torn down.I still need to hear the intent being behind this Image
In my district I see the spiral garage used to do donuts. We are criminaliing a new behavior. Is the County DA involved? Janz:No. Arias:we don't have to rely on the DA office then. I was caught up in a speed race. Anyone within 300 feet could be caught up too?
I don't want to add MORE cars fleeing the scene so they don't get a misdemeanor just by being caught up. Some PD Officers are young but we are asking to use their discretion. Who makes final call? Also those who are racing have the means for these $50,000 vehicles.I don't want to
be in Chavez' car and get caught up in a race he jokes. @esparza_nelson Can we use bodycam and other footage to determine who are actually spectators etc? There is an entire ecosystem of those to make these races possible. How would we create a local form of RICO to determine
this ecosystem? Chief: cars racing are directly racing on Blackstone v those coming down from Bay Area to meet at 2 am to sideshow or street racing .Esparza:Assembly Bill is piloting speed cameras to catch red light runners. Maybe not too late for Fresno to be included? Karbassi:
I am making a motion to postpone this until May 7th.(has to withdraw until Maxwell's comments) Maxwell:Has this been done in any other California cities? Chief:It has been done. Janz:I don't know if they have had any legal challenges from ACLU. Oldest is two decades. Maxwell:
I trust the PD Officers. If they charged a grandmother who happened to be caught up it will go to our City Attorney. I don't think we want to wait until we add more "flowery language". If we wait longer I don't think our constituents would like this delayed. This is similar to the
catalytic converter law we passed where we can charge those who are in possession of the converters even if we didn't catch them in the act. Bredefeld: I appreciate the comments today.I am pleased with it.I agree with Maxwell that we don't want to delay this. PD Officers use
their discretion every day. This was done in San Jose, Santa Clara and Turlock. Perhaps we can bring this back next week? Arias:If it changes significantly then the clock changes again. If we can change the language I am fine if we vote on it next week's meeting. Bredefeld:the
other cities had 200 feet so perhaps we drop it down from 300 feet so we don't catch up too many innocent. Chief:I first saw this bill 48 hours ago. Karbassi:I will make motion to bring this back next week if there is tougher language. APPROVED 7-0 to bring back next week.
UNSCHEDULED PUBLIC COMMENT: Susan Neville: I was box manager at Tower Theater and my son was technical director there. We had promoted events there.I treated the theater as my own. I was one of those who applied to run it now.Was there anyone not part of City on the committee? Image
Practic Shuka (?): I represent Radisson. We are a family based business. I am opposed to homeless conversion of a hotel. We felt City didn't let the neighbors know quick enough. They should be heard from. We already have damage from homelessness.David Willis:When City took away ImageImage
license of a hotel to another person?Did City ever think about a 12 month shutdown? How do they determine that? Moving would create more issues. Create more homeless. Buy the trailer park back.Scott Peterson: Thank you for buying Tower Theater. I applied to be one of the present- Image
-ers. We were never allowed to be in the theater or see previous financials. My partner Sterling. We have so many ideas for the theater. I have no issues with 980 participating. But please let us have another chance to apply. @LovesMercy I got a call that a homeless man who was
here at last meeting had his belongings taken by HART.Some lost work tools, paperworks. We need safe camps and need HART team to stop. People want to live in shelters were they are from. Many homeless are elderly. Linda Martinez:Hacienda By helping us they are kicking us out?? Image
We are struggling and confused by trailer park closing. Perla: 17 year old speaking on behalf of Bustos family . We are getting eviction notices at the trailer park. It is hard on parents and children. We need help. Patsy:I am being evicted out of Hacienda Trailer Park. where do I Image
move my trailer?? @_mcthompson Maria Thompson: These chambers were packed last year asking for help with this trailer park. Now you see less here. They have had to hand over keys in 5 days. This is illegal notices.People were told they can't rent anymore so many Image
bought their trailers instead. But Harmony then said the owners of those trailers have to reapply. Harmony paid $1 M and now have listed it at $4 M. Please do something different this time. Next:Families are being separated at homeless shelters. How can you help? Image
Leticia: From California Legal Assistance:the largest issue with mobile home parks were companies like Harmony removing tenants for another purpose. Fresno is having a homeless problem. And the Council's work on abating homeless will be for naught. Image
Sam Frank:The City Employees are thankful and we are giving you ,the Council, Certificates of appreciations. Maxwell:this is the first certificate i have received! ImageImage
Fernando: Masters of corruption. No shortage of money or water but a shortage of leadership. All you have done is take and hide money. Taking money from homeless.Taking somebody's house is not revitalization. Dez Martinez:Who is the Act Foundation? They are asking for $2M ImageImageImage
Kevin Foster from Lifebridge Church is listed as CEO.They own Stepping Stone pre-school. They have already put on their website they have affordable housing coming! I can't find any experience of them managing experience or working with homeless. If this group is under investi-
gation they should not be awarded. Lisa Pritcher of Bullard's Huckleberry. My owner is worried about the new conversion to homeless shelter. We have already have issues with homeless with damage. I even brought breakfast to 30 of the council members today. Kristin Popier: HART ImageImage
keeps evicting homeless everywhere we go.Let us have a safe camp. Street family needs a hand up. I apologize for how I looked last meeting. I am still working on myself.Next:Not enough family shelters. We need help not just from Mayor and PD but from Sheriff . Image
Michael Ibarra:Caltrans said they have sent out notices on closing Belmont offramp. They did not vet this very far. When was the traffic study done? 2021 when we were in a pandemic.Belmont is main road for funeral home processions. Closing this will make Hughes the main road for Image
this and it is narrow and dark. Please negotiate to have this offramp to remain open. Next:Economic development. I hope the social equity cannabis group. We first spoke about this in 2018.Leadership of Council needs better. Transportation and better policing. Help champion the Image
that should be part of taxation and the social equity language. Many of us cannabis applicants were dismissed anyway. City's work on Cannabis has driven more of the black market. Jefferey Nevill: Thank you for the work you did on Tower Theater. I was technical director there for Image
15 years.During pandemic it was put up for sale.New shows occurred but we were not notified so we could work like before.
by Zoom:@LisaYFlores1 drag racing ordinance needs to be reviewed through lense of being sued. Taxpayers cannot afford mistakes. At Roeding
during Easter the parking plan needs to be tweaked during my annual windshield survey. I counted empty spots. I was told they had to close 1100 spots were filled though. But the parking lot plan is getting close to perfection.Council needs to make the people at trailer park whole.
Alicia Rodriguez by Zoom:Some undercurrents on Tower Theater. Community was not at the table in selecting new management. Use the community as a resource! It will make this flourished. We deserve this.Community safety during protest and church that sponsored the drag
show only to be vandalized. Robert McCloskey:Not sure Council can do anything with Trailer Park.I do support purchasing more of these homekey inns. Valley Medical Center Hospital property that County owns at Cedar and Cesar Chavez Blvd will give 30 acres for homeless.
@laurasplotch333 by zoom:I fought for Tower Theater during protest and thank the Council like Perea and Arias. I do like the choice of those who are going to run it but I would like more community events like matinees on Sundays for kids. Go Numbskull! Cindy Piombino:Sad to hear
about Trails in. I am glad that opening homeless shelters in other districts too.We need warming centers in other districts too.HART team put hands on me too and they are bullies. Please sit down with me @BalderramaPaco to discuss that.
LUNCH BREAK until 1:30.
Council is back 1:38 pm (NOTE:they approved an item just as CMAC was coming on.Unsure which item that was)
10:15 ***Actions pertaining to Final Map of Tract No. 6371: RESOLUTION - Approving the Final Map of Tract No. 6371, and accepting dedicated public uses offered therein except for dedications offered subject to City acceptance of developer installed required improvements -
located near the northeast corner of East Floradora Avenue and North Armstrong Avenue (Council District 7) APPROVED with no discussion
CONTESTED CONSENT 1-B Actions pertaining to Commercial Cannabis Activity: 1. Approve the Loan Agreement for Maritza Estrada (the Owner) of Traditional - Fresno - ME LLC, a cannabis social equity business, in the amount of $75,000 to assist with the start-up, regulatory costs, and
operating costs of opening a retail commercial cannabis business in the City of Fresno. 2. Approve the Loan Agreement for Isaac Fonseca (the Owner) of Beyond Rooted 559 LLC, a cannabis social equity business, in the amount of $75,000 to assist with the start-up, regulatory costs,
and operating costs of opening a retail commercial cannabis business in the City of Fresno.Arias:how soon would they open if approved today? White:Equity Social program SHALL have this. It doesn't come from General Fund and can only go to that. Jennifer Reese Assistant City Mana-
ger: A building permit is needed and other permits before they open. They will need to construct within 120 days from getting building permit. City Manager:social equity applicants have been the slowest so far.Reese:they need more assistance.White:the other applicants have ex- Image
-perience from opening stores in other cities.Arias:I want to come back with deadlines to open or move on and allow others to take over. Industry want us to approve quickly but then they didn't rush once awarded. Our budget has some revenue figured from these stores. White:grant
money from State expires at the end of the month so we will reapply. Bredefeld:What happens if they cannot open?White:it will return money to state.Bredefeld:it is still taxpayer money. It is a misuse of taxpayer dollars and a disaster.I cannot support it. Esparza:Was that a
second he jokes? APPROVED 6-0 with Karbassi absent.
1-F Actions pertaining to Transient Room Tax: 1. BILL- (For introduction) Amending Section 7-602 of the Fresno Municipal Code, relating to compelling short-term rental crowdsourcing entities such as Airbnb, VRBO, etc. to collect Transient Occupancy Tax (TOT) on the City's behalf
and to remit the revenue to the City. Staff:this won't require self reporting but TOT would be administered by AirBnB. @D7Esparza I punch in AirBnB and there was 600 available but only 200 seen. It seems low.Staff:agree. woefully low. We are waiting for AirBnB to provide data.
Staff:We are not as far with VRBO. Perea:seems like 600 flying under the radar.Staff:it will be built in now.Perea:It has been shown these type of short term rentals raises rents for long term rentals. Esparza:We made a lot of amendments when this first came around in 2018.
I wanted a permitting fee put in. Staff:$25 and 12%. WE tend to use the AirBnB data in order to find those under the radar. White:can you share the research you used 2019? Esparza:Caprioglio wanted to kill AirBnb all together by Karbassi and myself made a series of amendments.
Arias:Sacramento charges $50 and 12%. We have a huge housing crisis. We don't need to incentivize losing those houses to short term rental. APPROVED
1-K Actions pertaining to the State of California's Homekey 3 Program and Quality Inn located at 6051 North Thesta Street (APN 409-200-43), to facilitate the development of permanent affordable housing (District 6) 1. Adopt a finding of Categorical Exemption pursuant to Section )
15301/Class 1 and Section 15332/Class 32 of the California Environmental Quality Act (CEQA) guidelines; 2. ***RESOLUTION - Authorizing a joint application to and acceptance of funding from participation in Project Homekey 3.0 to sustain and rapidly expand housing for persons
experiencing homelessness or at risk of homelessness, and who are, thereby inherently impacted by or at increased risk for medical diseases or conditions due to the COVID-19 pandemic or other communicable diseases and authorizing the City Manager to sign all required implementing
documents (Subject to Mayor's veto) Bredefeld:Grant is due Monday? White:opens Monday. Bredefeld:if I delay we will not be competitive ? A:Yes. Bredefeld:This will be permanent housing with kitchen and not homeless shelters.I am getting calls from businesses nearby like Huckel-
-berries who provided us breakfast this morning. We and myself included we should have notified the nearby businesses better. Staff:we will know by end of June if we are awarded this Homekey grant. Bredefeld:I want to move this forward with criterion that we hold community meet-
-ings with those businesses. APPROVED 7-0 Bredefeld:I hope this will make others comfortable with this project.
1-L Actions pertaining to the State of California's Homekey 3 Program and development of permanent affordable housing at 6507 North Polk Avenue (506-130-04) (District 2): 1. ***RESOLUTION - Authorizing joint application to and participation in the State of California's Homekey 3
Program to sustain and rapidly expand housing for persons experiencing homelessness or at risk of homelessness and authorizing the City Manager or designee to sign all required implementing documents. (Subject to Mayor's Veto). 2. ***RESOLUTION - In support of future City
Contribution of Funds for construction and development expenses associated with the project in an amount not to exceed $2,800,000 upon full award of Homekey 3 funding for the ACTS Foundation project. (Subject to Mayor's Veto). Arias:this is run by a brand new organization that
has only been around a year. Public comment says many worries that had some irregularities. We have not had a chance to vett them. I am hesitant to approve this. @AnnalisaPerea They are asking for $3M for a group that has a record of anti-LGBTQ behavior. @kmkarbassi I am sensitive Image
to what Perea says. We have a presentation of these two story modular projects that can be half the cost. It is on land that has been vacant. We don't require an RFP on these types of projects. Maybe we should. Staff:State released NOFA and that left projects to be ready in 30
days which not many can do. It will be targeted affordable housing. Karbassi: do we have the presentation? A:No Karbassi:Can ACTS Foundation discriminate? A:no. If they do violate it will go to City agreement , the MOU, Fair Housing Claims etc will be susceptible. These are for
aging out Foster children. ACTS Foundation is not experienced builder but we were given mandate to increase affordable housing. In order to do that we will need to reach out to new entities.ACTS has brought a team like Wathan, the Optimal modular development company as well.
ACTS brings experience in management. Also another part of the team is added so we felt comfortable with this group. It will be the first two story modular building and occupied in one year which is incredible. Karbassi:I have heard statements about Rev. Foster. I have heard it
may have been from a disgruntled ex employee so we will need to be careful using that to base this decision.Perea:ACTS has a good team around them. Can we just award the grant to the rest of the team and leave ACTS out altogether? Staff:ACTS brings the long term entity for the
next 55 years. Builder and developer will be done with their job in a year. Then the management is given to ACTS for next 55 years.Perea:So we are stuck with this team? Staff:We are requiring ACTS to reply to NOFA but I feel this is a strong team and incredible project. We hope
this can be a model for other private developers. Arias:I served on 3 Foster care boards. There is a strict rules on it. Due to that we have many other Foster Care agencies that are more experienced than ACTS. In their defense the claims against them have not been vetted.
I am hesitant to put this grant money to a team that has not been vetted and doesn't have the experienced. ACTS got the County to approve so maybe the County is better suited . Foster kids are the most vulnerable so we need to be sure to be careful.Staff:these are not kids as
they are 18-24. Arias:They have a history in Foster Care so even as adult so they are still vulnerable. Go find the experienced foster partner by Monday. Staff:ACTS has received a commitment from County to take care of these young adults. Would you prefer we find a Fresno based
group? Arias:ACTS doesn't have the experience but you say they have a strong team. Lets use another part of the team besides ACTS that has been vetted.Karbassi: I want to be sure we are treating this group as we would any other. Staff:there is a set aside. This is final homekey
and there won't be another round. Only $43 M in Valley this time. It will go to another city instead.Karbassi:Experience is important. The team will get this done on time and aged out foster students will have a home and in north Fresno. Makes motion to approve. Maxwell seconds.
Item fails 4-2

3-A Approval of revised Route 99 Freeway Agreement with State of California Department of Transportation (Caltrans) (Council Districts 1, 2, and 3) ImageImageImageImage
with Karbassi absent. Maxwell forgot to take public comments Now Karla Martinez on Zoom:we would like mitigation to help those living near by. @kieltls Excited about this but there are places that have lots of trucks already due to 180 and High Speed Rail and now this. Please
take that into account. @LisaYFlores1 I have had my dog park group at Roeding for ten years but why am I just finding out about this? Also a small community near Belmont off ramp will be isolated.
Moving onto CLOSED SESSION Some items:
