Back in the courtroom. Adrian telling those in the audience yet again to not use their cellphones during the afternoon's testimony.
Det. Nick Eddy with the Quincy Police Department has been called to the witness stand. Because an easel Josh Jones plans to use blocks Eddy's view of the clerk, Adrian decides to swear in Eddy himself. #bliefnicktrial
Eddy reviewed text messages on Becky's phone between Becky and Ted Johnson. He said he noticed no disagreements or arguments between Becky and anyone else on her phone. #bliefnicktrial
After Becky dialed 91126 on the morning of Feb. 23, Eddy said she didn't dial her phone again. Eddy then checked photos taken in Tim's car on March 2. A pair of gloves are shown on the dashboard, and two more pairs of gloves were found under the driver's seat. #bliefnicktrial
Also found in the back of the car was an Aldi's bag. An app called "Our Family Wizard" was found on Tim's phone. Slides taken from the phone show Tim asked on Feb. 21 if Becky could keep the kids on Feb. 22 because he didn't feel good. #bliefnicktrial
Becky responded she could keep them. Tim said she could keep them overnight. She was going to pick them up from school. The discussion turns to a blue bike that was found a half-block from Tim's residence. #bliefnicktrial
Eddy said the bicycle was checked for DNA, not fingerprints, because it was left outside for a few days. Eddy also said Ted Johnson was given a gunshot residue test. He said he didn't know of a potential time of death during the Johnson interview. #bliefnicktrial
Eddy said there was no information found that would lead him to believe Johnson was a suspect during a six-hour interview. Eddy then talked about videos that were found at 20th and Hampshire, a residence on South 20th and a house west of Becky's house. #bliefnicktrial
Eddy said he saw something unusual on Feb. 23, a person on a bike headed in the direction of Becky's residence. "Most people don't ride their bike in the middle of the night in the middle of February," Jones said. #bliefnicktrial
A video from South 20th correlates with times at the Bus Barn and a video from Taylor Heimann's home. Video from the Bus Barn on Feb. 14 at 12:29 a.m. The video shows someone on a bicycle on the sidewalk. Can't tell anything about the person. #bliefnicktrial
A video a minute and a half later at 12:31 a.m. shows someone riding their bike south on 20th Street and east on Prairie Avenue. Another video from Taylor Heimann at 12:37 a.m. showed a person on the driveway. #bliefnicktrial
Another video at 12:52 a.m. from the Bus Barn shows someone on a bicycle riding north on 20th Street. No videos over the next six days showed anyone riding a bicycle, but there was video on Feb. 21. #bliefnicktrial
Another video at 1 a.m. from the Bus Barn shows someone riding a bicycle south on 20th Street. A video from the South 20th residence a minute and a half later shows someone riding a bicycle on 20th and turning on to Prairie Avenue. #bliefnicktrial
There is no video from the Heimann residence on Feb. 21. Video from the Bus Barn at 1:17 a.m. shows someone riding a bicycle north on 20th Street. Video also shows someone riding south on 20th at 1:41 a.m. and north on 20th at 1:56 a.m. #bliefnicktrial
On Feb. 22, at 12:57 a.m., a person is shown riding a bike south by the Bus Barn. A minute and a half later, video shows a person riding south on 20th and then turning east on Prairie Avenue. At 1:05 a.m., video from the Heimann residence shows someone walking by. #bliefnicktrial
Video at the Bus Barn later shows someone riding north on 20th Street at 1:10 a.m. Video at 1:46 a.m. shows a bicyclist headed south on 20th Street, and at 1:48 a.m., a bicyclist is shown at South 20th residence. Tim turns to watch the videos but doesn't react. #bliefnicktrial
Video at 1:53 a.m. at Taylor Hermann's residence shows someone outside, and 15 minutes later, a bicyclist is shown headed north on 20th Street. Video from Feb. 23 shows at 12:55 a.m. someone riding a bike by the bus barn. #bliefnicktrial
At 12:57 a.m., video from the South 20th residence shows a bicyclist headed south on 20th and east on Prairie Avenue. At 1:16 a.m., a video from the Bus Barn shows someone riding north on 20th Street. Eddy says a test bike ride was done at night. #bliefnicktrial
Video of the test bike ride is shown. The bicycle that was used did not have the same reflectors. #bliefnicktrial
Cellphone records are then shown. They show the last call on Tim's phone on Feb. 13 was made at 7:38 p.m. The next call wasn't made until Feb. 14 at 1:32 a.m. There is a gap from 4:37 p.m. on Feb. 21 until 9:29 a.m. on feb. 22. #bliefnicktrial
Another gap shows Tim didn't use his phone on the morning of Feb. 23 until 8:01 a.m. (Sorry, can't keep up with all the exact times.) Next is a review of the defendant's laptop. #bliefnicktrial
Laptop searches show Tim started to look up license plate searches at 1:10 a.m. on Feb. 14. On Feb. 21, there is no internet activity for several hours until 7:01 a.m. Feb. 22. Later on Feb. 22, no activity from 8:15 p.m. until 6:02 a.m. on Feb. 23. #bliefnicktrial
Eddy put together a report on when Tim's cellphone was locked and unlocked. On feb. 21, the cellphone screen was locked at 12:44 a.m. and unlocked at 5:30 a.m. On Feb. 22, the cellphone screen was locked at 12:50 a.m. and unlocked at 1:15 a.m. #bliefnicktrial
The phone is locked at 1:39 and unlocked at 2:22 on the morning of Feb. 22. Phone is unlocked at 12:38 a.m. and locked at 2:07 a.m. on the morning of Feb. 23. The courtroom takes a break to stretch. Adrian said he asked the clerk to lead in calisthenics, but she declined.
Eddy also received information from a WHOOP fitness tracker that Tim owned. It was taken from Tim on March 1. Eddy said more than 1.4 million lines of data were received. The device is charged with a battery pack so the device isn't removed from the wrist #bliefnicktrial
Information is sent through Bluetooth from the device to a phone. Eddy said on Feb. 14 the WHOOP device was not connected to the phone from midnight to 1:10 a.m. #bliefnicktrial
Eddy said on Feb. 21, the WHOOP device was not connected to the phone from 12:45 a.m. to 2:11 a.m. On Feb. 22, the WHOOP device was not connected to the phone from 12:42 a.m. to 1:16 a.m. and from 1:39 a.m. to 2:19 a.m. #bliefnicktrial
Eddy said on Feb. 23, the WHOOP device was not connected to the phone from 12:36 a.m. to 2:01 a.m. Eddy said the WHOOP device had no significant gaps on any other day he reviewed the data. #bliefnicktrial
Schnack asked if Eddy has received specialized training about how to interpret the WHOOP data or if he was ever employed by the company. He says no. She then asks about the charging band with the battery pack. She asks about charging the battery pack. #bliefnicktrial
Eddy says information will stay on the strap when it is removed from the wrist and then upload later. Information downloaded to an app on a phone or a tablet. "If there's no bluetooth connection, the data can't sync?" Schnack asks. Eddy says yes. #bliefnicktrial
Schnack asks more about possible bluetooth gaps. She asked if someone from WHOOP provided an explanation of the data. She asked if the only certainty about the gaps in the WHOOP tracker meant it wasn't connected through bluetooth. Eddy says he didn't know. #bliefnicktrial
Schnack asks about the search of Tim's vehicle on March 2. A swab search was done for DNA inside the vehicle. Eddy said by looking at the gloves, they appeared to be adult sizes. Schnack asks about the $13,000 in cash found by Ted Johnson in a bag of Becky's. #bliefnicktrial
Eddy said he didn't know where the bike was before it was picked up by QPD, only that it was found four days after Becky's death. Adrian asks for the attorneys to come forward. They're now going to go into the judge's chambers for a conference. #bliefnicktrial
Adrian returns. Schnack continues with cross. She asks if the bike is the same as the one used in the video. Eddy says he can't confirm. He said videos from the Bus Barn were purged from prior to Feb. 13. He asked for videos from Feb. 13-28. #bliefnicktrial
Eddy said no other times or dates of video were requested for review. He said he had two officers canvassing the area for video, but he doesn't know for how long or how many doors were knocked on. Schnack says videos can't tell where person is going. #bliefnicktrial
Eddy says the long gaps of time on the phone and the laptop just mean no phone calls were being made, and the searches were all done online "but that doesn't mean there wasn't activity someplace else." #bliefnicktrial
Eddy says he was at Tim's house when during search. QPD also searched three waste lagoons and a pond by a trailer park, as well as 20 acres near the trailer park. Eddy said nothing was found. He also said 800 tons of trash was sifted through and nothing was found. #bliefnicktrial
In re-direct, Jones notes the times that Tim's phone was locked, so the phone couldn't be used. The gaps in time on the WHOOP correlate with the videos of someone riding their bicycle. #bliefnicktrial
Eddy steps down from the stand. Jones says the people rests. #bliefnicktrial
Adrian tells the jury several matters must be taken up outside their presence, so the jury is going to be excused for the day. The trial is expected to resume at 9 a.m. Adrian says, "You haven't heard all of the evidence." #bliefnicktrial
Adrian says the courtroom will be in recess for 15 minutes. #bliefnicktrial
We're back in the courtroom. The jury is not present. Schnack makes a motion for a directed verdict "in light of a lack of evidence." She says jurors are going to be left to believe he left his kids at home, rode his bike, murdered Becky and rode his bike home. #bliefnicktrial
"We don't know who this person is on the video," Schnack said. In respect to the bike, the crime lab recovered nothing to tie evidence to Tim. The bike was found near Tim's house, not at his house. "It appears to be a random bike with no association to Tim Bliefnick," she said.
The crowbar and multi tool are not linked to being used by Tim in opening the window. Schnack said no less than six pairs of shoes were taken from Tim, and the one pair of shoes sent to the crime lab excluded Tim. #bliefnicktrial
Schnack says the gloves have no DNA linking Tim to the crime. The shell casings have no DNA or fingerprint linking Tim, and the gun has not been found. She calls the conversations with Becky and friends "girls blowing off steam at work." #bliefnicktrial
Becky never told her attorney she was worried about Tim. Schnack said the Aldi bags being used as a silencer is not supported by the evidence. "We have video, but you can't see who is in the video," Schnack said. #bliefnicktrial
She says the state has failed to meet the burden of proof. Jones says he think it's clear there's enough evidence that Tim shot Becky. "We have to look at the evidence as part of the whole," Jones said. #bliefnicktrial
Jones asks for the motion for the directed verdict to be denied. Adrian says he has considered the evidence and the motion, and he chooses to deny the motion for the directed verdict. Asked if her client is going to testify, Schnack says a firm decision has not been made.
Adrian asks Tim is he knows his decision to testify is his decision. He says, "I do." Schnack says she will present evidence beginning Wednesday morning. Adrian is going to ask in the morning if Tim has decided to testify. #bliefnicktrial
If Tim doesn't testify, Adrian says closing statements could be made Wednesday morning. If he does testify, "then we'll have to see (about closing statements)." #bliefnicktrial
The court reporter is excused. Adrian then chooses to discuss jury instructions "off the record" in front of those remaining in the courtroom. #bliefnicktrial
Reviewing jury instructions is complete. Adrian asks for the attorneys to be present by 8:45 a.m., at which time a decision on Tim's testimony will be made. #Bliefnicktrial
