1. Todd Blanche may regret winning the motion to remand the NY state Trump criminal case to state court. To win he needs a ruling that Donald Trump was an officer of the United States. If he does, here's something that will come from that, something Blanch and Trump may regret.
2. The removal statute that Blanch used to take the state prosecution away from NY state court and put it in the SDNY, 28 USC 1441, requires that the former president be an "officer of the United States." I personally don't think case law supports it but Trump claims that he is.

Todd Blanche has filed his opposition to Alvin Bragg's motion to remand the Trump criminal proceeding to NY state court. Consistent with what I have thought all along the case is likely to be remanded because the remand statute does not cover a former president because they,

Removal is something you do a lot in civil litigation. State lawsuits often give rise to diversity jurisdiction in federal court and you file a notice of removal and remove the case lock, stock and barrel to federal court. It usually sticks. Base on citizenship and domicile.
