This is the exchange I’ve been waiting for.

@RepAdamSchiff demonstrates Durham’s disregard of clear evidence of Trump Campaign-Russian collusion.

Durham admits he lacks knowledge of undeniable parts of record, indicates why his report ignores episodes.

2. Durham also says he read some things “in the media” (to suggest it may be less than reliable news reporting).

What?

It’s in the Mueller report, the bipartisan Senate intelligence Report, and something he appears to have overlooked in U.S. Treasury report. …
3. It’s even worse.

Schiff notes Manafort as Chair of Trump Campaign shared polling data with Russian agent Kilimnik.

US Treasury in 2021 said USG has now assessed Kilimnik “provided the Russian Intelligence Services with sensitive information on polling and campaign strategy.”
4. Here’s @justinhendrix’s write up of the 2021 U.S. Treasury statement.

With this quote by @AWeissmann_ at the time:

“This is new public information that connects the provision of internal Trump campaign data to Russian intelligence.”

@justinhendrix @AWeissmann_ 5. Finally, here’s my April 2019 detailed guide to evidence of collusion presented in the Mueller Report.

The most important ones are nowhere to be found in the Durham Report.

That’s why I’ve been waiting for this telling exchange.

6. Addendum

More Q&A.

Schiff is very effective at this.

It goes to the very heart of Durham’s fundamental flaws.

And Durham is being completely exposed here.

1/ How much federal prison time does former President Trump potentially face?

This analysis corrects a lot of misinformation circulating out there.

Former DOJ official (@davidcaaron) applies the U.S. Sentencing Guidelines to charges in Trump Indictment.

justsecurity.org/86901/how-much…
2/ Espionage Act potential offense level:

Base level with Top Secret documents: 29
Leadership role: 4
Abuse of trust: 2
Obstruction: 2
Total: 37

For a defendant with no prior criminal convictions, an offense level of 37 yields 210 to 262 months (17 1/2 to almost 22 years).
3/ Obstruction potential offense level:

Base level: 23 (or 19 under 2J1.2)
Leadership role: 4
Abuse of trust: 2
Total: 29 (or 25)

For a defendant with no prior convictions, an offense level of 29 yields 7 1/4 to 9 years; and an offense level of 25 yields 4 3/4 to almost 6 years

Tim Parlatore interview w/ @jaketapper:

- says "absolutely right" storage was "not secure"
- admits 2 Chinese national intruders at MAL
- admits Indictment strong
- admits allegations really serious
- says kept in dark on moving boxes to avoid searches

cnn.com/videos/tv/2023…
2. Extraordinary exchange:

TAPPER: "That's a room where everybody who is in Mar-a-Lago has access to."
PARLATORE: "Sure."
...

TAPPER: "But there have been at least two Chinese national intruders."
PARLATORE: "Sure."
...

PARLATORE: "That's absolutely right, that is not secure."
3. Notice Tapper opens by giving Parlatore an opportunity to say anything he'd like about the indictment.

Parlatore starts out saying he was kept in dark about moving boxes to avoid lawyers' searches. Admits it would be "certainly problematic" especially if backed up by video. Image

<Thread> Former Trump supporters/legal advisors who have come out in favor of truth on #TrumpIndictment.

Trump's Attorney General Bill Barr on Fox News Sunday:

"If even half of it is true, then he's toast ... It's very, very damning."

"Espionage Act...are solid counts."
2. And prominent lawyers:

“The evidence in this indictment is very damning for the former President."

- @JayTownAlabama, former U.S. Attorney for the Northern District of Alabama (2017-2020)

Interview with @KenDilanianNBC @NBCNightlyNews
3. Plus conservative legal commentator:

“It’s a devastating document. If they can prove half of it, he’s toast.… They can probably prove more than half of it, because a lot of it is recorded conversations, testimony from his lawyers, and that sort of thing.”

- @AndrewCMcCarthy

This is devastating. I have looked at all prior prosecutions under the Espionage Act and have never seen egregious facts like this.

Trump "stored his boxes containing classified documents .. in a ballroom, a bathroom and shower, an office space, his bedroom, and a storage room." Image
2. Meaning all cases of Espionage Act for retention of such documents.

Special Counsel alleges the Iran attack plan is indeed a classified document that Trump shared.👇

Extraordinary risks to U.S. national security. Foreign adversaries would pay tens of millions for that info. Image
3. Nauta is going to jail. He may well still flip and cooperate with this open and shut case.

"NAUTA found several of TRUMP's boxes fallen and their contents spilled onto the floor of the Storage Room" including marked SECRET and for Five Eyes only

He texts photo to Employee 2: Image

This looks like highly damning evidence for the prosecution.

“Secret. This is secret information. Look, look at this.”

@PaulaReidCNN @jeremyherb @CNN obtained the transcript.

2. This is so significant that it raises the question whether there could be a superseding indictment for dissemination of classified documents/national defense information.

cnn.com/2023/06/09/pol…
3. From earlier NYT reporting:

“In the batch that went to the archives [in January 2022], there was one document concerning military options for Iran.”

* Espionage Act *

ABC News: The charges include "willful retention of national defense information."

(As I have long predicted.)

That offense fits the alleged conduct, a perfect match.

3. According to ABC News the charges also include:

"Conspiracy"
"Scheme to conceal" [sounds like 18 U.S. Code § 1519]
"False statements and representations" [sounds like 18 U.S. Code § 1001]
