In one of the most significant 1st Amendment victories in years, a 5th Circuit panel (only one of whom is a Trump appointee) rules that the Biden WH, the FBI, CDC, and Surgeon General violated Americans' core free speech rights by coercing Big Tech to censor on their command. Image
The appellate court largely upheld a court ruling from June. In doing so, it explained: courts have "rarely been faced with a coordinated campaign" of censorship "of this magnitude orchestrated by federal officials." The result was "suppressing millions of free speech postings." Image
The court barred the agencies it found to have threatened and "commandeered" Big Tech censorship -- the WH, the FBI, the CDC, and the Surgeon General -- from further coercion of this type.

It was particularly scathing about the FBI's censorship of domestic political speech.

The appeals court -- finally -- gave the lie to the defense of Democrats that this censorship was merely Big Tech acting on its own.

In 2021, I argued that Democrats' explicit threats to Big Tech -- either censor how we want or face reprisals -- constituted censorship of the kind banned by Bantam Books and the 1st Am.

The court yesterday applied the 2nd Circuit's Bantam test to rule.

Self-identified Communists for the ADL.❤️

These soft DNC leftists spent the whole week insisting that their support for the ADL in its censorship campaign against Musk didn't mean they actually like the ADL.

This new candor should be cathartic and make them feel better.
It might seem surprising that this crowd of DNC leftists would align themselves with *ADL*, including many who ADL called anti-Semites.

But as I've been saying, they have *no higher priority* than censoring the internet, and thus see ADL - like the CIA/DHS - as their key ally.

I can't stress this enough:

After Brexit and Trump, the neoliberal establishment in the West was genuinely traumatized.

Their main conclusion: it's too dangerous to allow the internet to be free. It leads to outcomes we can't control. And the *mainstream* left fully agrees.

I knew it left-liberals would soon rise in defense of the ADL and smear its critics as anti-Semites. These are the same people who are now the CIA and FBI's most vocal defenders.

But it's bizarre to watch this defense of ADL be led by those whom the ADL has called anti-Semitic:

Left-liberals still dislike the ADL for their steadfast defense of Israel, but a much higher priority for them than Palestinians is retaining the power to censor dissent from the internet, and the ADL is a key ally in that goal:

We have a Special Episode on tonight's @SystemUpdate_ on exactly this issue: how @ADL abandoned its stated mission to weaponize anti-Semitism accusations, all to fortify the neoliberal censorship regime and establishment liberalism.

They now barely hide their real function.
Bernie would never say it now, but in 2016 he complained about DC groups that pretend to be about a specific cause -- HRC (LGBTs), Planned Parenthood (pro-choice) -- but are just arms of the DNC, exploiting those causes to serve the Dem establishment:

The top 2 priorities of CIA and the US Security State:

1) Infinitely prolong the war in Ukraine to weaken Russia.

2) Control online political speech to banish dissent.

It's not the role of ADL, or any advocacy group, to set the limits of political speech. ADL also partners with PayPal to identity "extremists" (ie those who disagree with ADL leaders), who then get banned.

(ADL is just a pro-Dem group exploiting anti-semitism for that cause):
