I haven’t read every word 98 pp GA Indictment & I don’t practice criminal law. But I can’t imagine DOJ attorney @JeffClarkUS circulating a DRAFT letter, through channels for discussion at DOJ in DC, which was never sent, could be a crime under state law. Ridiculous!
How many bullsh*t letters has Garland’s DOJ actually sent to state and local officials all over the country, making unfounded reaching claims of discrimination or violations of the endangered species act or somesuch nonsense. Are those all CRIMES now? Gimme a break!
Local prosecutors have no business reaching into and prosecuting the internal deliberations of the federal government, just as states can’t TAX the federal government. Right or wrong, it’s a purely federal matter. Hope @JeffClarkUS knocks this one out the park early.
Advice from a litigator of 30(+) years. .@bonchieredstate & .@Cernovich are correct. Don’t bet the house on talking points or attacks on the feds or judges. This is serious business. Trump faces genuine peril. Wait and watch what the lawyers actually file & judge rules. No joke.
In legal proceedings, there are many things that can and often do go wrong, including evidentiary and procedural issues, unknown facts that suddenly pop up, forgetful or non-credible or disappearing witnesses, presumptions, burden-shifting, new legal precedents from other courts.
I’ve won cases I “shoulda” lost, and lost cases I “shoulda” won. So has every other experienced litigator or trial attorney. This isn’t dreamland.
