2:40pm EDT: We're back in the continuing #EastmanTrial. Eastman is in a tan, almost khaki looking jacket with a spread collar and a brown check striped tie. He's sitting in front of four Japanese shoji panels. Duncan Carling said he's nearly done, asking about exhibits:

JE: Yes I did, looks like 1/2.
DC: There's a summary...

DC: It says you were a speaker, do these bullet points reflect what you said?
JE: Don't recall but probably.
DC: Remember what states legislators on the call were from?
JE: AZ, GA, WI, MI & PA but not certain.

DC: Did you discuss with any state legislator the idea of signing a letter to Pence?
JE: I don't recall having those conversations.

DC: Has anything in this #EastmanTrial changed your view on fraudulent ballots or the election?
JE: Garland Favorito's testimony strengthened my view -- votes flipped in Ware County, his audits showed thousands of ballots were counted multiple times...
DC: Did you give any consideration to the impact of your remarks on 1/6 on the crowd?
JE: No, was only 3 minutes & they were waiting for Trump
DC: Anything in the trial made you change your mind?
JE: No. Gableman's testimony showed illegality in nursing homes etc opened the door to fraud in WI. His evidence in his report was pretty compelling. 200K votes affected the
DC: Was there outcome determinative fraud in the election?
JE: From Justice Gableman... I think there was more than enough fraud to be outcome determinative. I don't know the extent of fraud, but I do know illegality.
JE: Jesse Binnall's evidence in NV that people getting paid for their ballots were fraud... ballot harvesting indicates fraud.
DC: You don't know if there was outcome determinative fraud in NV?
JE: I don't know if fraud or illegality.
DC: You don't know if there was outcome determinative fraud in GA?
JE: I think fraud of people voting after moving, no signature verification, signature not matching... those were greater than the margin. Add Favorito's 5K votes counted multiple times, those were outcome determinative.
DC: So unlike NV & WI, GA was outcome determinative?
JE: Yes & WI opened the door to fraud.
DC: AZ?
JE: I saw evidence in AZ that 35K ballots were injected which would have affected the outcome.
Judge: Outcome determinative fraud in GA & AZ?
JE: No involvement in AZ, saw evidence...
Judge: Yes or no
JE: Yes, if evidence is accurate...
Judge: OK, so you're qualifying.
JE: Trying to be precise, I saw evidence, don't know if it's true because not involved.
DC: Was there outcome determinative fraud in NM?
JE: Don't know.
DC: Was there outcome determinative fraud in MI?
JE: Didn't see but looked like it.
DC: Was there outcome determinative fraud in PA
JE: Yes
DC: Is that from Ryan Report?
JE: No, from Jesse Morgan, he didn't know if it was 200K or 250K trucked in with pallets of ballots.
Judge: So because of Jesse Morgan you believe there was outcome determinative fraud?
JE: Yes because of his sworn statement.
I think Seligman ignored a key point about in the historical record that Congress was not to have a role in resolving electoral disputes.

Randall Miller is LEADING again & judge is helping him rephrase.

Between Randy Miller's constant leading questions & time management problems, Judge Yvette Roland has been very patient. Duncan Carling keeps objecting, Miller's questions asked & answered. John Eastman and Miller are lucky they aren't being slapped with a fish. #EastmanTrial

Miller is walking Eastman back through the Oval Office meeting on 1/4. We've heard this before.
RM: Did you withhold any information?
JE: No.
RM: Did Greg Jacob (VP Pence's lawyer) seem to have researched the issue?
JE: Yes.
Judge: This has been covered, anything new?

Miller has presented 3 different version of the "Pence Card" memo by Ivan Raiklin. Ivan has been serially, constantly wrong. "Election denial activist behind “Pence Card” theory tells QAnon show he contacted multiple members of Congress to push plan". mediamatters.org/january-6-insu…

JE: No, and I still don't.
RM: Other reports?
JE: Jenna Ellis drafted a memo on the role of the VP on 1/6 in Dec 2020
RM: Did you review it? Directed to?
JE: I did. To Trump or legal team, don't recall.

JE: Don't recall...
Judge: Did you not talk to your client Trump about other legal memos being drafted for him by other attorneys?
JE: No, wasn't time, didn't talk with him often...

Miller brings up the chart again with the number of legislators who questioned the election.
JE: There were a number of letters sent to members of Congress & legislators, in MI & elsewhere... multiple letters raising illegalities in the election.

Miller shows Eastman a letter from a MI Senator signed by other legislators (2 more pages of signatures).
JE: These were the kind of things that were being sent to me & they raised the illegalities I was concerned about.
Example of a document Eastman considered 11/20-1/21.

Another Michigan letter... Eastman says these were in line with his concerns.

Miller puts up an Arizona letter Eastman doesn't recall. Miller is bringing up exhibits that haven't been stipulated to yet.
