🧵🧵 1. Well, the courts are now CLOSED for 2023!
2024 is looking to be a big year in the courts for the Freedom Movement. We're expecting a few judgments/decisions and a number of cases to progress. Here is a list of freedom movement & other cases of interest:
2. Anti-lockdown activist mentioned the other day that one of her priorities for 2024 is court cases - "both offensive & defensive" !!
On the defensive side, she's being prosecuted by Consumer Affairs Victoria for alleged unlawful fundraising.
3. Monica is pleading not guilty to the charges. Her next court date is 22nd January (a mention).
4. On the "offensive side", Monica is suing Victoria Police for alleged unlawful arrest over this incident:
5. After numerous failures to comply w/ court deadlines including vacating the original trial date, it appears Monica *may* be applying to discontinue the proceedings.
A hearing is listed for 23 Jan to hear the application.
6. Still on the "offensive side", Monica has announced she's planning on suing Brett Sutton for the 21 days she spent in custody.
Considering she ELECTED to spend the time in custody, this will certainly be an interesting case...
7. The NSW Law Society is seeking disciplinary orders against anti-mandate lawyer Nathan Buckley.
Nathan tried to stop the case progressing but was unsuccessful. The parties return to NCAT in February for a case management hearing.
8. Despite the Voice referendum not succeeding, suspended doctor Billy Bay is still trying to challenge its validity!
In 2023 the High Court dismissed his challenge to the Voice as an "abuse of process". He's now trying to appeal that decision...
9. The other suspended doctor, Mark Hobart, recently lost his appeal against the Medical Board's decision to suspend his registration. He's now filed an application for special leave to appeal in the High Court.
Like Billy, he loves a High Court challenge!
10. Clive Palmer reckons he's going to sue the former chair of ASIC
11. Lawyers behind 2 failed COVID vax challenges took Pfizer & Moderna to court, arguing their vaccines constituted GMOs.
Pfizer & Moderna applied to have the case summarily dismissed on grounds it had no prospects of success.
We're currently awaiting judgment...
12. 500+ ppl are part of a COVID vax injury class action against the Cth Govt. They say the decision to approve the vaccine constitutes negligence & malfeasance.
The Govt intends to apply for the case to be dismissed on grounds it's hopeless w/ no prospects of success.
13. Former sports presenter Warren Tredrea is suing Channel 9, claiming the network unfairly dismissed him b/c he refused to get the COVID vaccine.
After a lengthy hearing, the court has reserved its decision. Currently awaiting judgment.
14. Then there's suspended lawyer Serene Teffaha's class action against the Victorian Legal Services Board and the Commonwealth Bank...
#WillNeverHappen
15. And disendorsed OneNation candidate Rebecca Lloyd's class action against ASIC over their Director ID laws!
🧵1. Earlier this year, conservative US commentator Candace Owens was denied a visa to Australia on grounds she has “capacity to incite discord”
She’s now challenging that decision in the High Court of Australia!
In this thread I explain what her case is all about!
2. This case is very different to Djokovic’s legal challenge over the Minister for Home Affairs’ decision to deny him a visa. In that case, Djokovic essentially challenged the WAY the Minister made his decision to deny him a visa
3. HERE, Candace is challenging the LEGISLATION that gives the Minister the power to deny her a visa!
🧵 1. The no longer suspended doctor Bay vs AHPRA & the Medical Board.
In this thread, I summarise the court’s decision: why Bai is no longer suspended, why his Constitutional argument failed, and what the possible future brings for Dr Bay
2. This case was an application for “judicial review” by Dr Bay. He applied to the QLD Supreme Court for a review of the following 2 decisions of the Medical Board: the decision to suspend him & the decision to investigate his conduct
3. What is judicial review? It’s the power of a Court to review decisions of government agencies or public bodies. The role of the Court is to determine if the decision was properly made – the focus is on the law & how the decision was made, not the MERITS of the decision
🧵 1. What happens when lawyers behind a failed lawsuit against Pfizer & Moderna accuse the presiding judge of bias because the judge happened to have a science degree & a cousin who once supported medical research?
A judicial smackdown of course!
2. Background to this drama:
Controversial doctor Julian Fidge decided to sue Pfizer & Moderna, claiming their COVID vaccines were genetically modified organisms & illegally unlicensed under the Gene Technology Act
3. Justice Rofe of the Federal Court dismissed the case summarily, on the basis that Fidge lacked “standing” to bring the proceedings. Fidge used the same lawyers who’d once represented the Australian Vaccination-risks Network (cont)
🧵 1. Three doctors who were suspended for issuing fake COVID vax exemptions have attempted to overturn their suspensions in the High Court of Australia! The High Court refused to let the self-represented doctors file their application, on grounds it was an abuse of process
2. Doctors Mark Hobart, Valerie Peers & Denes Boros sought to commence proceedings in the High Court against the CEO of AHPRA and the Chair of the Medical Board
3. Each doctor had been suspended during the height of the pandemic, pursuant to the Board’s “immediate action” powers. Each doctor was suspended for similar reasons: allegedly issuing fake COVID vax certificates & promoting misleading info about COVID vaccines
Day 3 of Closing Submissions and Final Day of the Hearing!
#DeemingvPesutto
Yesterday Dr Collins KC made some compelling arguments re: the republication of Pesutto's Media Release in MSM. After Collins' closing submissions, Sue Chrysanthou SC (SC) will give her Reply. Will be interesting to hear how she rebuts this argument.
After a 5 minute delay, Court is now in session again!
