Attended Ray Epps sentencing today - what a farce.

The prosecutor praised Epps "de-escalation tactics" and had a whole slide show for it entitled "Attempts to De-escalate."
Both Judge Boasberg and the prosecutor both claimed "he never tried to go into the Capitol."
The prosecutor claimed he struggled and that he could give Epps a felony with a low sentence or a misdemeanor with a high sentence.
The prosecutor claimed Ray Epps case was a "unique and complicated case," I don't see how.
I also don't see any other J6 defendant getting this type of special treatment where a prosecutor claims their case is "unique."
The prosecutor said they used their prosecutorial discretion to choose to charge Epps with misdemeanor - despite that same prosecutor arguing 10 minutes before that Epps had engaged in felonious conduct.

Epps and his lawyers along with the government and Judge Boasberg all agreed Ray Epps was the victim of "widespread conspiracy theories."
The DOJ themselves admitted they were giving Epps a "significant break."
The prosecutor argued "6 months is the appropriate sentence."
The prosecution then proceeded to praise Epps - claiming he actually SUPPORTED LAW ENFORCEMENT OFFICERS that day.
Epps lawyers pointed out Epps called the FBI almost immediately on 1/08/2021 and that he gave voluntary statements and cooperated.
Epps was allowed to speak and he said the FBI had "nothing to do with what happened on January 6th," he blamed @FoxNews for "peddling election integrity conspiracy theories," and he blamed Trump.
He then said that he believes January 6, 2021 was an "insurrection."
Epps lawyer claimed people called Epps a "boomer" on January 5 when Epps was recorded on video urging rally attendees to go into the Capitol the next day. Baked Alaska and others started changing "fed fed fed," but Epps lawyer claimed Epps was trying to "de-escalate" and that "Baked Alaska and others didn't listen to him [Epps]."
@FoxNews Epps lawyer made the claim Epps "just said we should go down to the Capitol," and claimed he never told people to go in - the government did not dispute this claim.
We have seen video evidence that contradicts this though.
@FoxNews Epps lawyer then made a big thing about how Epps in a post J6 interview with a citizen journalist talked about what happened on J6 being "symbolic."
His lawyer said to Epps it was just a "symbolic amplification of his voice," to Epps.
Epps lawyer made the astounding ADMISSION that the government MADE A FORMAL DECISION IN 2021 NOT TO CHARGE RAY EPPS.
He said they reviewed all his conduct that day formally deciding no charges were warranted.
He then complains Epps is a "victim" because the government decided to do a show misdemeanor charge.
Then Ray Epps lawyer made an ASTOUNDING ADMISSION: he claims that after reviewing footage of Epps and his conduct the government made a FORMAL DECISION IN 2021 NOT TO CHARGE EPPS WITH ANYTHING.
He then claims Epps is being unfairly treated now with the government giving his a misdemeanor show charge.
Epps lawyer argued that probation for him as a sentence would promote "accountability."
Epps in his statement not only lashed out at Fox News but he lashed out at what he called the "Trump Cult," who he blames for his conduct.
He then praised the FBI and antifa saying conclusively they had "no involvement" in January 6 and that only "angry trump supporters," were part of the "mob."
Epps said the 2020 election was "not stolen" and that he wants to spend the rest of his life trying to explain that to others.
He wants to speak about the "truth of the election results," and he assured Judge Boasberg he no longer gets his information from "Fox News" and he trusts the government.
Judge Boasberg praised the government for being "balanced" in their presentation.
Judge Boasberg claimed Epps initial conduct "probably warranted jail time," but then cited his extensive cooperation with the government, J6 farce Committee, etc and other "mitigating factors" to give Epps a sentence of 12 months probation and NO TRAVEL RESTRICTIONS.
He then called January 6 an "insurrection," and he slammed "conspiracy theorists," who claimed the FBI was involved. Judge Boasberg says more important than Epps conduct on January 6 was "what happened after," and he cited Epps and his wife as "victims" of these conspiracy theories and "harassment," which he claims is at a level he hasn't "seen before."
So there you have it - Epps is a "unique and complicated" case and is a "victim of widespread conspiracy theories," totally not an FBI informant, fed or working for a contractor that contracts with the feds which is why he got this amazing sweetheart deal and praise from the government and fisa judge lol
Addendum: forgot to add how Judge Boasberg disregarded the video played of Epps helping to push this massive Trump flag that was over 20 feet long into a line of Capitol Officers by claiming "anyone might put their hand up to protect their head if a big sign is coming."
That was actually amazing - I'm sure no other J6 defendant got this benefit of the doubt again that contrasts the video evidence of what happened that day.

Contrast the Ray Epps sentencing yesterday with Stephen Horns sentencing today - very different!
So @BankofAmerica has decided to "terminate" their business relationship with me. Their "risk department" made this determination for literally no reason. I have been with them for years. This is clearly because of my documentary and my critical reporting.
They won't tell me why. They won't allow me access to my bank account or to the funds. They are telling me I will get a "check in the mail" but they won't say when I can expect it. I am traveling at the end of this month for my documentary. Now I have no funds.
They wouldn't say when the check will come. I have a documentary film shoot in less than 2 weeks and I have crew members I need to pay, etc.
The Appeals lawyer for Adam Fox has submitted his Reply Brief to the Government's Response to Adam's Appeals Brief.
Fox's Appeals lawyer argues that his Brief raised four assignments of error, and the government responded three months later.
Fox is now responding to the government's Brief, addressing his first two assignments of error.
The District Court abused its discretion by depriving Fox of a "constitutionally meaningful" Remmer hearing and the District Court abridged Fox's right to confront his accusers by arbitrarily restricting his ability to cross-examine Kaleb Franks.
A Court confronted with a credible claim of juror bias must undertake an investigation of the relevant facts and circumstances. While the Courts have discretion, that is not infinite.
Fox's lawyer argues a District Court must fulfill its duty to investigate and determine whether there may have been a violation of the Constitutional guarantee of a fair trial by impartial jurors. Typically, when a claim of juror bias is made, a Remmer hearing is conducted where the defendant has an opportunity to demonstrate bias. One of the reasons the District Court's "discretion" in establishing the procedure to investigate is not limitless is this Circuit stands alone by placing the burden of establishing juror bias on the defendant.
In the Sixth Circuit, if a defendant makes the requisite showing, a District Court ABUSES its discretion by DENYING him a "meaningful opportunity" to demonstrate the juror bias.
He argues that, at minimum, the investigation must be reasonably calculated to resolve the doubts raised by the juror's impartiality.
Immediately after hearing Barry Croft's lawyer's summary of his phone call with a caller, later referred to as Person #1, detailing Juror #13's statements evidencing his bias, the District Court themselves acknowledged "that would be juror misconduct if true."
I attended the sentencing for journalist @stephenehorn who was charged with 4 misdemeanors for being a journalist on January 6th.
Today's tone was markedly different from the Ray Epps sentencing I attended yesterday.

I had coffee with Stephen early this morning prior to his hearing. We talked about his journalistic endeavors, his documentary and mine.
This case has major implications for civil rights, freedom of the press, freedom of speech, etc
The district court is in a bleak, old, stuffy, imposing, and oppressive building that has extremely low tech TVs and monitors with clocks that are not even working.
Regarding the FBI's planned "daytime recon" of Whitmer's cottage, here is the FBI planning it, and wanting to "maximize attendance." Special Agent Chambers tells CHS Dan to "get Brandon Caserta to go" on the government's planned "recon."
The government has repeatedly asserted that Adam Fox and Barry Croft were "ringleaders" of their fake plot.
Today "UCE Mark" aka Special Agent Mark Schweers claimed Adam was directing people and giving orders on the "recon," but audio from the same recording shows CHS Dan, CHS Steve, and UCE Red doing the "directing."
CHS Steve tells CHS Dan, "We'll put Adam and Barry together."
The FBI picks people up, drives the vehicles, even arranges seating.
Here we have "UCE Red," aka Special Agent Timothy Bates asking "Alright fellas, where the F we going," to which Barry in the backseat says "Destination unknown."
CHS Dan asks UCE Red if he wants him to "drop him off and flip back around," - again this contradicts UCE Mark's testimony today under oath that Adam Fox was "giving orders" at night time recon.
UCE Red attempts to frame Barry by getting him to go pose under the bridge the FBI is trying to get the guys to want to "explode."
Barry thankfully doesn't fall for this part of the ruse, but Adam did.
UCE Red - NOT ADAM - is giving orders and directions, tells Adam to bring his phone so FBI can induce him to take and post photos they can then use against him as "evidence."

The FBI rolls up on this elderly man to ask him about social media posts and he says "I said it was a dream." Then he asks them to not return without a warrant.
