I have filed a motion to compel the government to identify active-duty FBI employees who were in the crowd at the Capitol with former FBI Liaison to Capitol Police John Guandolo on January 6.
My filing also includes a sworn declaration from John Guandolo in the case of Kowalke v. David Eastman, where Guandolo attested under penalty of perjury that he was with an FBI special agent at the Capitol.
Guandolo has also acknowledged in several interviews that he was with multiple active-duty FBI agents at the Capitol on January 6, and that they introduced him to other FBI who were in the crowd.
In his Kowalke v. Eastman testimony, Guandolo gave a nervous answer about whether he was "on the job" on January 6, but did testify he was not working as law enforcement. Guandolo spun his UTT - (Understanding The Threat) organization out of his DOD work in asymmetric and information warfare.
Capitol CCTV that has not yet been released by @SpeakerJohnson shows Guandolo's active-duty FBI colleagues. Since that video is still under seal, I can only show some of these colleagues in images taken from public video.
@SpeakerJohnson This CCTV shows that Guandolo and these active-duty FBI agents went into the area that the government alleges was restricted on January 6. I have redacted the background of this exhibit since @SpeakerJohnson has not yet released camera 0948 to the public.
Guandolo also posted video from January 6 to YouTube (now removed). I was able to find an archived copy and sync it to CCTV to show that Guandolo's active-duty FBI colleague was vigorously clapping and said "This is HUGE!" as people went up the steps. Sadly, I cannot show you that CCTV since @SpeakerJohnson has not yet released camera 7231 to the pubic. But here is Guandolo's video with subtitles.
I have emailed the unredacted version of my filing, and the sealed video exhibit showing the clapping FBI agent to @SpeakerJohnson, @JudiciaryGOP, and @HouseAdmin. Since Congress owns the Capitol CCTV, they are free to make them public, or continue hiding them from the public (in violation of Speaker Johnson's promise to release the CCTV), if they wish.
I will be happy to provide these items to any Senator or Representative who wants a copy, as well as J6 defense teams who have signed the protective order governing discovery.
For J6 defendants who have cases on the west side of the Capitol, Guandolo and his FBI colleagues walked onto the west lawn (inside the government's alleged restricted area) at about 2:58 p.m. Guandolo's included this clip in his J6 video montage that was recorded at ~3:05 p.m.
Unfortunately, a clip of DEA Agent Mark Ibrahim (who was at the Capitol with an FBI informant) was cut off right before Guandolo and his FBI colleagues walked around the SE corner at 2:55 p.m.
DEA Agent Mark Ibrahim was charged for flashing his badge and gun at the Capitol on January 6. This clip from BattleBrothersTrading is the video the cuts off right before Guandolo and his FBI colleagues walked past. Both Ibrahim and Guandolo were in Nick Searcy's Capitol Punishment.
The government has motioned for an extension of time (until 3/14) to respond to my motion to compel identification of the FBI agents who celebrated people running up the Capitol steps. My opposition to the government having an entire month to respond is included in the filing:
Judge Contreras has granted the government's motion for an extension of time to respond to my motion to identify the FBI agents who cheered people going up the Capitol steps.
@EpochJoe64 has written a good article covering my motion to identify the active duty FBI agents who were in the government's alleged restricted area at the Capitol and celebrating as people ran up the east steps. theepochtimes.com/us/court-asked…
Here's some public footage showing Guandolo and his FBI colleagues inside the government's alleged restricted area at 2:55 p.m.
Since @SpeakerJohnson has made camera 0948 public, I can now unredact Figure 10 from Page 14 of my motion, which shows former FBI Liaison to Capitol Police John Guandolo walking inside the government's alleged restricted area with his active duty FBI colleagues.
Speaker Johnson has also now released Camera 0767, which gives a clear view of Guandolo's clapping colleague. My motion seeks to compel the government to identify these FBI agents so they can testify in court.
Here's the video from Camera 0767 showing Guandolo walking with the colleagues that he has described as active duty FBI. As they walk off screen Guandolo appeared to have an interaction with someone to his right (seen better on another camera), then #FenceCutterBulwark and #ShamrockSheep appear.
Note, the video jumps a few frames because this was the gap between two CCTV video files at 2:55 p.m.
The government notified me today that they filed a motion to file redacted and sealed responses to my motion to compel identification of FBI employees who were with former FBI liaison John Guandolo. I have not yet seen this hit the docket, nor have I seen their sealed response.

I just filed a supplement to my selective prosecution motion. This filing provides 17 videos exhibits including never before seen CCTV from 15th and Constitution showing Ray Epps and Megan Paradise repeatedly inducing the crowd to go to the Capitol.
These videos show Ray Epps repeatedly going through the crowds on the morning of January 6, telling complete strangers to go to the Capitol.
In this clip, Ray Epps walks up to David Sumrall and the StopHate crew to have a conversation. Sumrall infamously discussed "physically taking Congress" on a podcast with CIA Kevin Shipp 5 months before January 6, and bullhorned people onto Capitol grounds after Epps entered.
Let's do a mini thread on some of the people caught with guns and other weapons on January 5 and 6 who you've probably never heard of. You'll be surprised to find that many received far lighter sentences than most January 6 defendants 🧵
First up is Thomas Gronek from North Carolina who was on the Hippies for Trump bus that got pulled over on January 5. Gronek brought a pink Ruger 10/22 rifle, with 275 rounds of .22 ammo, and a black 9mm Springfield handgun with 31 rounds of ammo. Gronek was detained until February 18, 2021. On April 1, 2022, his felony charge was pled down to misdemeanor attempted carry. Gronek was sentenced to time served (about a month and a half) and a $50 fine.
Harlan Boen from Colorado was arrested on January 5 for carrying a Glock 23 at Freedom Plaza. Boen allowed officers to pat him down, and then waived his Miranda rights. Boen was released from custody the next day, January 6, but faced felony charges. On December 15, 2021 he pled down to misdemeanor attempted carry, and received a suspended 45 day sentence (none served), a $50 fine, and 60 days of probation.
Is it normal to be operating a baby stroller and a K-9 at the same time? What exactly did those CIA K-9 teams on January 6 look like?
Here's some more footage of our stroller K-9 unit at about 3:20 p.m. (as seen on camera 0942 - digitally enlarged). She seemed to be walking back and forth through the crowd, and stopped to talk with another dog handler.
Here's the K-9 Stroller entering Capitol grounds at the Maryland walkway just about 2:42 p.m.
The K-9 handler initially wore a large overcoat, then did an outfit change, and positioned near the walk for an extended period.
This time I'll be exploring 24 hours of Dome Camera 0906, which face South - the direction of the RNC and DNC pipe bombs. Brace yourself for more interesting finds and more Congressionally blurred footage.
Let's start at midnight - January 6 has just begun. Unfortunately, camera 0906 is either out of focus for several hours, or has been intentionally blurred by Congress. Because of that, we don't have crisp details of what happened in the middle of the night.
It's also important to note that the pipe bombs were supposedly plants on the night of January 5. Since Congress has only released video from J6 so far, not J5, they are still withholding important clues from the public. This video put together by @RevolverNewsUSA gives some background:
🧵Part 2
More than two million people have already viewed my thread on Camera 0903, which shows strange activity in the middle of the night and morning, but I've only gotten through ~noon on January 6. To avoid clutter, this thread will cover the second part of the day.
At about 12:40 p.m. on January 6, Camera 0903 is zoomed in on a sidewalk area. Congress has intentionally blurred this footage to hide the details of who the people moving through here were.
However, at 12:20, Congress did not blur this same shot. Both of these clips come from the same 20 minute file, and both are before Ray Epps ran past the gates. So, Congress is intentionally hiding the identity of some people but not others.
The @HouseAdmin Committee is trickling out blurred footage. They recently released West Dome Camera 0903. Here are some interesting finds:
Although they say they are now releasing entire cameras, the House Admin Committee has withheld footage from the early morning hours of January 6.
This includes gaps from between 12:40 a.m. and 1 a.m., and between 1:20 a.m. and 2:20 a.m.
Here is the minute before the 12:40 gap:
Immediately following the hour long gap between 1:20 and 2:20, the Capitol Police Command Center used camera 0903 to follow a white box truck. Then they zoomed in on people walking on the National Mall and in a parking lot on the west side of the Capitol.
