This guy seemed insane, but I got curious cause all the Apple blogs are smearing him so I went into PACER...

Here's the Judge finding the FBI illegally tracked the guy via his Tesla, illegally spied on the guy with AT&T data, and illegally arrested him without a warrant or probable cause, and then illegally searched his storage locker & car too.

This guy was convicted of 1x communicating a threat to injure (18 U.S.C. § 875c)

Only claim still standing at the end was that guy lurked around the FBI building & said he'd take go "beyond taking [an agent's] livelihood"

Apple said far worse shit to me & FBI won't call me back
I remember reading Apple's restraining order requests against this guy and the guy did seem unhinged, and it does sound like he probably illegally threatened the FBI, which is bad

But this case is so incredibly suspect if you start reading the docket entries - I have a lot of qs
Here was a request for a restraining order filed by the Santa Cruz PD in December 2021. The Police Officer explains that "an Apple employee" called them and reported this guy & asked for a psych assessment. PD called the guy who said Apple was conspiring against him. image of filing
Santa Cruz PD's star witness is an anonymous Apple employee (assumably Workplace Violence), and they cite other Apple employees but refuse to give the cops the other employee's names.

PD complains the guy kept asking to give the cops evidence of misconduct by Apple...? Image
When the Santa Cruz PD petitioned for a gun violence restraining order, the police department noted that they were represented by a private law firm... ?

Apparently the private firm's managing partner is City Attorney for the City of Santa Cruz....?

FBI affidavit confirms it was Apple Global Security who reported the guy to the FBI

Lead FBI investigator is Special Agent in charge of Violent Crime, ex-DOD, specializing in firearms & narcotics

When this guy was pulled over in June 2022 (the later found illegal de facto arrest and illegal search) he had a huge amount of Apple products with him

Guy used to be an AppleCare advisor

Guys lawyer complained in September 2023 that the police will not tell them what is happening with the devices

& refuses to produce evidence, including emails with FBI and AT&T, or any records of the FBI tracking the guy's Tesla, or any records of the data provided by AT&T

FBI agent for violent crimes & gangs says guy was posting YouTube videos calling for an "insurgency"

After request for an interview, guy emails FBI crazy (but prob not Illegal?) emails such as: “YOU OBSTRUCTED THE WRONG INVESTIGATION,” and “YOU OFFENDED THE WRONG AMERICAN"

During the trial, FBI / DOJ attempted to suppress any evidence that would prove the guy had no actual intention to carry out his threats, and/or guy had no actual ability to carry out his threats. Sounds like Judge would allow the evidence so then DOJ dropped the YouTube videos

When they arrested this guy, they apparently sent a US Marshal to Alabama. Court filings extensively reference referrals from Apple Global Security

Does this guy sounds like someone who should have weapons? DEFINITELY NOT

Did a US Marshal need to track him down in Alabama? ....

In Feb 2024, guy's lawyers complained everyone agrees guy had a mental breakdown, so wtf

& complains about gross violations of the guy's 4th Amendment rights, including:

FBI getting surveillance data from AT&T as part of "an informal phone call" & lying to Tesla to get car data

There's a lot going on in this case, but we should prob talk about the FBI SF Office orchestrating (per the Judge) illegal searches, illegal arrests, getting illegal warrants; & getting personal data from AT&T via "informal phone call" & from Tesla by lying about an subpoena... Once the Government finally did produce this discovery, it revealed that the Government’s position throughout the suppression litigation—that the FBI had relied on § 2702(c)(4) of the Stored Communications Act—was false. The Government produced no record of the FBI having relied on the SCA. Nor did the Government produce any evidence of its fallback argument, that the FBI requested the information from AT&T on an exigency basis. Indeed, Government counsel acknowledged to defense counsel that the FBI made its request as part of an informal phone call.

III. CONCLUSION  The Court GRANTS the motion to suppress the information obtained pursuant to the March 11, 2022, prolonged detention and de facto arrest, including the observations, materials, objects, and any other evidence that flows from the stop. The Court defers ruling on the motion to suppress the information obtained pursuant to the warrantless search of Defendant's real-time CLSI and the evidence obtained from the June 3, 2022, and June 8, 2022, warrants.

Third, regarding the Government's argument that the FBI relied in good faith on the SCA, the Court observes that there are numerous cases warning the FBI that real-time CSLI is not data contemplated under the SCA. See, e.g., Cooper, 2015 WL 88157, at *5; Espudo, 954 F.Supp.2d at 1036. More importantly, however, there is no evidence that the FBI relied on the SCA at all. The SCA is not cited in its communications with Tesla, and the Court cannot make the determination of what the agents relied on in obtaining the information from AT&T because the Government has failed to provide the agents' ...

It's the 4 year anniversary of Apple putting me on leave a few days after EPA announced a CERCLA inspection of the cracked floor at my toxic waste dump office based on my whistleblowing. To celebrate this anniversary, I'd like to share Apple's 8/4/25 discovery responses...⬇️

🧵DOJ charged 7 employees & eBay itself with serious felonies (ie stalking, tampering with witnesses, obstruction of justice) over their 2019 harassment campaign. 2 of the 7 were recent Santa Clara city police captains (partners to the HazMat agency enabling Apple's illegal fab).
If you missed this eBay case, definitely go catch up. Read the news & also the legal filings - the whole thing is absolutely wild.
Two of the ringleaders of eBay's felonious nightmare were Philip Cooke and Brian Gilbert. One of the infamous parts of the case is Cooke and Gilbert conspiring to mislead police and FBI about their activities, & Cooke texting: “Good plan and cover, Brian.”

I obtained this info through Public Records requests over the last year & half. At first city HazMat was refusing to release most of this, but I finally broke them down this year. Apple has extremely toxic gases at the site (next to homes, public parks, a playground…), with a known risk of literal catastrophe. Even if fab is properly zoned there's still extreme risk that cannot be fully mitigated. So Apple surely had state of the art monitoring equipment?

EPA's report explained Apple is exhausting its fab emissions into the outdoor air. The only abatement technology Apple used was 2 activated charcoal boxes for the entire factory (no scrubbers), & Apple never evaluated it to determine if it would actually neutralize the chemicals.

Apple wasn't monitoring the amount or contents of its emissions, & had no permits for its exhaust. So Apple can't know what was being dumped into the air. However, Apple guessed that after the charcoal, it vented at least 7000 – 16000 kg of chemical vapors into the air EACH YEAR. graph showing total hap emissions by kg

🧵In 2020, I nearly died from mysterious industrial chemical exposure at my home. Later I discovered my employer was dumping toxic waste into our windows from their Skunkworks semiconductor fab next-door. I tipped off EPA, who raided them in 2023. US EPA Enforcement & Compliance conducted 3 onsite inspections of Apple's fab facility in 8/2023 + 1/2024. US EPA noted at least *19* potential violations of the RCRA hazardous waste statute.

After discovering what Apple did, I then spent three months requesting records & digging through regulatory filings to learn more - which led me to file a complaint to US EPA in June 2023. I met with their investigators & sent them everything I discovered.
