U.S. District Court, California Northern District (San Jose), Case No. 5:22-cr-00251-EJD-1
1/x Docket Report
Here's the Judge finding the FBI illegally tracked the guy via his Tesla, illegally spied on the guy with AT&T data, and illegally arrested him without a warrant or probable cause, and then illegally searched his storage locker & car too.
This guy was convicted of 1x communicating a threat to injure (18 U.S.C. § 875c)
Only claim still standing at the end was that guy lurked around the FBI building & said he'd take go "beyond taking [an agent's] livelihood"
Apple said far worse shit to me & FBI won't call me back
I remember reading Apple's restraining order requests against this guy and the guy did seem unhinged, and it does sound like he probably illegally threatened the FBI, which is bad
But this case is so incredibly suspect if you start reading the docket entries - I have a lot of qs
Here was a request for a restraining order filed by the Santa Cruz PD in December 2021. The Police Officer explains that "an Apple employee" called them and reported this guy & asked for a psych assessment. PD called the guy who said Apple was conspiring against him.
Santa Cruz PD's star witness is an anonymous Apple employee (assumably Workplace Violence), and they cite other Apple employees but refuse to give the cops the other employee's names.
PD complains the guy kept asking to give the cops evidence of misconduct by Apple...?
When the Santa Cruz PD petitioned for a gun violence restraining order, the police department noted that they were represented by a private law firm... ?
Apparently the private firm's managing partner is City Attorney for the City of Santa Cruz....? abc-law.com/firm-overview
FBI affidavit confirms it was Apple Global Security who reported the guy to the FBI
Lead FBI investigator is Special Agent in charge of Violent Crime, ex-DOD, specializing in firearms & narcotics
For the apparently mentally ill guy sending weird and off-putting *emails*
When this guy was pulled over in June 2022 (the later found illegal de facto arrest and illegal search) he had a huge amount of Apple products with him
Guy used to be an AppleCare advisor
Guys lawyer complained in September 2023 that the police will not tell them what is happening with the devices
& refuses to produce evidence, including emails with FBI and AT&T, or any records of the FBI tracking the guy's Tesla, or any records of the data provided by AT&T
FBI agent for violent crimes & gangs says guy was posting YouTube videos calling for an "insurgency"
After request for an interview, guy emails FBI crazy (but prob not Illegal?) emails such as: “YOU OBSTRUCTED THE WRONG INVESTIGATION,” and “YOU OFFENDED THE WRONG AMERICAN"
During the trial, FBI / DOJ attempted to suppress any evidence that would prove the guy had no actual intention to carry out his threats, and/or guy had no actual ability to carry out his threats. Sounds like Judge would allow the evidence so then DOJ dropped the YouTube videos
When they arrested this guy, they apparently sent a US Marshal to Alabama. Court filings extensively reference referrals from Apple Global Security
Does this guy sounds like someone who should have weapons? DEFINITELY NOT
Did a US Marshal need to track him down in Alabama? ....
In Feb 2024, guy's lawyers complained everyone agrees guy had a mental breakdown, so wtf
& complains about gross violations of the guy's 4th Amendment rights, including:
FBI getting surveillance data from AT&T as part of "an informal phone call" & lying to Tesla to get car data
There's a lot going on in this case, but we should prob talk about the FBI SF Office orchestrating (per the Judge) illegal searches, illegal arrests, getting illegal warrants; & getting personal data from AT&T via "informal phone call" & from Tesla by lying about an subpoena...
US Gov argued they can track people's GPS whenevs & 4th Amendment isn't implicated in real-time CSLI tracking
US judge: "It is well-established that individuals have a reasonable expectation of privacy in their historical CSLI under the 4th Amendment" casetext.com/case/united-st…
Apparently US gov's key evidence against this ex-Apple employee included vid of employee lurking / stalking FBI outside their office, supporting the "true threat" claim
In the video, guy said he was watching FBI "because they don't work hard enough" & cheers "catch those crims"
"During the grand jury proceedings, several grand jurors expressed concern about Broderick’s mental health. One inquired whether he had been offered a psychiatrist & opined the Gov should focus on whether Broderick needed help, instead of wasting the grand jury’s money & time..."
This guy reminds me of the "Jerry" character from the 1997 "Conspiracy Theory" movie
Is he insane? Yes.
But, also - are they actually all out to get him? Yes.

There's something I want to write about in depth, but don't have time now, yet its too timely to skip
I dug deep into the ebooks antitrust suit against Apple
Apple harassed, & got smear articles published about, & harassing emails sent to...their federal court-appointed monitor
When the US Court appointed a monitor to ensure Apple stops violating the Sherman act, Apple didn't respond well
The monitor? A prior DOJ Inspector General, & special counsel on Iran-Contra
Apple's response to him included direct & indirect harassment, intimidation, & smears
What caught my eye on this, was Apple's initial response to the court order, of trying to 'DARVO' their monitor, Michael Bromwich, in retaliation after he refused to act as Apple's subordinate & not a literal rep of the US gov. Apple tried to sue him & orchestrated FUD & smears.
🧵 Remember in May 2021, when Apple entered into a real estate 'mega deal' w/ my ex-landlord Irvine Co, for property on toxic waste clean-up sites, the same weekend Apple mysteriously closed my worker's comp claim abt toxic waste chemical exposure?
Let's see how they're doing...
Here's a map of the area: Apple, Synopsys, LinkedIn
For ex-coworkers who were there or moved in later, this includes: Mary 5-6, 12, 14-18; Palomar 1; & Almanor 1
The area is a toxic hellstew & the county environmental health dept keeps yelling at them about a half-arse cleanup
In addition to some known hot spots (Siemens plume, etc)
Groundwater testing in 2018 showed PCE, TCE, & 1,2-DCE in shallow-ish groundwater
🧵 I'm reviewing my 2020 medical records now I know Apple was venting silicon fab poison in my apartment windows at the time of my mystery illness
Things that didn't make sense with a Brownfield clean-up site, now make a lot of sense with ongoing releases
Like Arsenic poisoning
On September 9 2020, I went to the hospital for a big blood draw to conduct my own medical monitoring program on myself - after exposing myself to the chemicals in my apartment the night before
& that night I had a 3am death spell
v-blog of that night:
Until this year, the Arsenic didn't make sense.
First, there was Arsenic known to be at the cleanup site, but heavy metals are heavy - how would it travel up 3 floors? (Apple's Arsine gas!)
Arsenic was high in my serum but none in my urine.
Apple's hazardous waste training manual says that in case of a hazardous waste spill or leak
1) employees SHOULD NOT clean up the spill
2) employees SHOULD call the Worldwide Loyalty team
3) Worldwide Loyalty will liaise with EH&S to determine if Apple has to tell the gov
I'm sorry, Apple, you're doing what with 'infectious agents'?
Apple's Haz Waste spill documentation fails to mention anything about telling non-employees who are downwind from the poison leak about the poison leak
I tried to get the local press to write about what happened - the illness & toxic waste - but they refused, afraid of the property manager (Irvine Company)
So, I drafted an article myself & finally found one local paper willing to publish the story.

My article was published on March 26 2021. I heard from env activists, but I wasn't sure how many tech people would actually care.
Then, I woke up one Sunday morning, on April 4 2021, with an email in my inbox informing me I had 'gone viral' on something called 'HackerNews'.
