To what extent has #Israel annexed occupied #Palestinian territory and created a fait accompli tantamount to the crime of #aggression? Events of yesterday and today in #AlAuja (West Bank) serve as a case in point: Image
Yesterday, Bezalel Smotrich (Min. of Finance and Overseer of Occupied Territory), Idit Silman (Min. of Environmental Protection) and Zvi Sukkot (Chair of Judea and Samaira Parliamentary Committee) visited #AlAuja and vowed to permanently displace this #Palestinian community.
This morning #Israeli armed forces entered the #Alauja, and destroyed several livelihood structures. According to initial reports, a wanton and extensive demolition without any military necessity, in grave breach of #IHL.
The ministerial visit (and subsequent destruction of property) was prompted by Elisha Yard, suspect in the killing of 19-year-old Palestinian Qosai Jammal Mi'tan in August 2023. This is the message he circulated yesterday congratulating ministers for dispossessing Palestinians. Image
This is what @UNHumanRights High Commissioner @volker_turk told @UN_HRC #HRC55 on the intrinsic link between settlers and #Israel's government policy. Image
@UNHumanRights @volker_turk @UN_HRC I underscored that #Israel's annexation is an act of aggression, the supreme international crime.

The targeted killing by #Isarel of seven World Central Kitchen @WCKitchen humanitarian relief personnel in #Gaza is not a "tragic incident," as Israeli officials put it, but a culmination of normative problems, going back decades. A thread: Image
1/5 A permissive attitude on the use of force by #Israel in #Gaza has already led to the killing of numerous @UNRWA staff and the destruction of its premises, in breach of the 1946 Convention on the Privileges and Immunities of the @UN: Image
2/5 In 2009, during hostilities in #Gaza, #Israel carried out direct and intentional strikes on #UN premises. The Board of Inquiry concluded that the attacks amounted to an egregious breach of the inviolability of premises, which could not be overridden by military expediency.

UPDATE: According to #Israel’s published figures, between 7 October 23' and 28 March 24', 252,585 tons of food were allowed into #Gaza, averaging 1,460 tons a day - only 35 percent of the minimum food intake of 4,191 tons a day Israel itself calculated.Image
Yet, #Israel stated on Friday that "we outright reject any allegations according to which Israel is purposefully starving the civilian population in #Gaza." In fact, depriving the population of 65 percent of its minimal daily food ration amounts to intentional starvation.Image
The law of armed conflict #LoAC prohibits the "use of starvation of the civilian population as a method of warfare," understood by @ICRC API Commentary as an attempt to reduce the population to starvation or force it to move.

Here is my reflection on the additional provisional measures indicated by the @CIJ_ICJ in the Genocide Convention case, given, as the #ICJ holds, "the worsening conditions of life faced by #Palestinians in #Gaza, in particular, the spread of #famine and #starvation," a thread: Image
The Court ordered additional provisional measures "in view of the prolonged and widespread deprivation of food and other basic necessities to which the Palestinians in the #Gaza Strip have been subjected," with "famine setting in."
The Court then reaffirms the measures indicated and concludes that the "catastrophic situation in the Gaza Strip confirms the need for immediate and effective implementation of the measures indicated."Image

Expose by @Haaretz this morning - #Israel's military uses #US Korean War (1950-1953) surplus ammunition in #Gaza, leading to indiscriminate and reckless targeting, in what could very well be a grave breach of international humanitarian law #IHL. Image
According to sources within #Israel's military, the expired ammunition and antiquated weapon systems (the M109 Howitzer, in service since 1963) led to a "sharp increase in the risk of misfire and targeting errors." Image
Customary #IHL rules dictate that a party to the conflict must take "all feasible precautions in the choice of means and methods of warfare with a view to avoiding, and in any event to minimizing, incidental loss of civilian life, injury to civilians and damage to civilian objects."Image

Some aid into besieged #Gaza - through airdrops and (reportedly) amphibious vehicles departing Cyprus - is better than no aid to the intentionally starved population. But there are three normative and operational caveats: Image
1. The crude volume of humanitarian relief required - over 500 truckloads a day - cannot be matched by even the most extensive aerial and maritime operation. Nor does it resolve issues with prioritising distribution and ensuring a dignified and safe delivery.
2. #Israel obligated - as underscored by the #ICJ - to enable the provision of basic services and humanitarian assistance to #Palestinians, would not be absolved by the fact that its allies airdrop or land aid on Gaza's beaches. Israel, the occupying power, is alone responsible.

#Israel inaugurated 'Road 749', running the 7 km width of #Gaza, south of Gaza City and intended as a permanent route for Israeli ground forces. Permeance designed to acquire occupied territory indefinitely. Image
Just north of Road 749 is what remains of the Karni Crossing, dismantled by Israel in 2011 when it was last operated. #Israel intends to use it as a log base from which aid will be provided to sympathetic "villagers associations" in #Gaza. Image
This idea dates back to 1974, when #Israel wanted to have #Palestinian appointees - subordinated to Israeli staff officers - manage civil life (including education, health and relief) in the West Bank and Gaza. Image
