It was the longest day we've had since this trial began. In the afternoon, we heard the confessions Richard Allen made to prison guards at the Westville Correctional Facility where he was held for more than a year.
-We heard first from John Galipeau who was the former warden at Westville
-He went through what Allen's was life was like there
-Allen was on suicide watch for most of his time there
-He would have "suicide companions" watching him and monitoring what he did and said
-Galipeau said initially other inmates were monitoring Allen but that changed after he started acting "erratic"
-Prison guards took over as his suicide companions
-Galipeau said Allen started washing his face in the toilet and pooping in his cell
-Then Allen wrote a "request for interview" form which said "I'm ready to officially confess to Killing Abby and Libby"
-Here's a recreation we did during a viewing of exhibits last week:
-During cross examination, defense attorney Brad Rozzi pointed out that the area Allen was in was maximum security and house inmates who had conduct violations
-Rozzi reminded everyone that Allen was a pre-trial inmate and not convicted of a crime
-Galipeau told Rozzi he had never heard of a "safekeeper" (aka pre-trial inmate) being held in a pod like that in his 28 years with IDOC
-Galipeau said that because Allen was on suicide watch, he had more limitations than other inmates and was watched at all times
-Rozzi tried to ask about Galipeau being fired from the Department of Corrections but McLeland objected and Judge Gull agreed because it was outside the scope of what McLeland had asked about
-We then heard from 8 prison guards who were Allen's suicide companions
-All of them heard Allen confess to the murders in some sort of fashion
-Officer Michael Clemons heard Allen say "I'm glad nobody gave up on me after I killed Abby and Libby"
-Also heard Allen say "I'm not crazy, I'm only acting like I'm crazy"
-During cross, Rozzi asked if he heard Allen mention specific details? The answer was no.
-Clemons told Rozzi that other inmates would call Allen a "baby killer" and would tell him to kill himself
-During re-direct, Clemons said he didn't think Allen was crazy
-Next was Michael Robert who heard Allen say "I want to confess. I know a lot more"
-He also said "I killed Abby and Libby. My wife wasn't involved"
-He also heard Allen talking to himself saying "why are you doing this? Do you know god?"
-Allen also said things like "I'll take some KFC", "Am I already dead?" and "Can I go home? Am I in jail"
-During cross examination, Robert said he witnessed Allen smear his poop on the walls of his cell
-Roberts also saw him bang his head on the wall until it was bruised
-He also said Allen would stand in the corner and run naked
-Next was James Early
-He heard Allen say "I am ready to confess. I swear to god I killed Abby and Libby. Fuck me running"
-During cross, Early said he saw Allen penetrate himself with a spork
-Early also witnessed Allen drink from his toilet
-When Rozzi asked Early if it would be detrimental to someone's mental health to be in those conditions? He said yes
-Officer John Miller heard Allen say "funniest joke is how I killed them"
-Allen also told Miller he killed his family and grandchildren
-Miller said Allen told him a "bear claw" was hypnotizing him.
-Miller told the jury he didn't think Allen's mental health issues were genuine
-Then came Brandon Fisher who heard the most detailed confession
-Fisher says Allen said "he killed two girls in Delphi with a box cutter and threw it in the CVS dumpster"
-Fisher says Allen also said "he was going to rape them but panicked and killed them instead"
-He was banging his head on the wall while making some of these statements
-During cross, Rozzi began to ask about Fisher being fired from IDOC for providing false info but prosecutor objected and it was sustained
-Fisher told Rozzi he thought Allen was putting on an "act"
-Fisher said Allen would bang his head on the door while asking people to read the bible to him
-Fisher said Allen would also pretend he was in medieval times
-Allen also rubbed his poop on his face and left it there for two hours while in Fisher's presence
-Officer Raymond Smith said Allen told him "I killed those two girls so I have to kill myself"
-Smith also witnessed Allen standing in the corner of his cell naked and singing "God Bless America"
-Smith said Allen then began masturbating in front of the door
-Last was Jason Bedwell who works at the Wabash Valley prison where Allen was moved
-Said he heard Allen say "I'm sorry for what I did. Sorry for killing the girls" while he was laying down and crying
-Rozzi pointed out that there is no recording of that statement like the others
-For reference, here's the change Allen underwent while in prison
-In motions to get him moved, which were eventually granted, Allen's lawyers said Westville was like a prison of war camp
-They included these pictures as part of their evidence
-Jury was sent out around 6:30
-Many of them were looking at the clock towards the end of day
-Confessions we didn't hear about today are the ones Allen supposedly made to his family members
-We'll see if that comes up tomorrow

force a refresh
-The prosecution rested its case a little before 4 this afternoon
-Before that happened there was an issue with a video the prosecution wanted to show that took more than an hour to resolve
-Prosecution wanted to play a video of Allen in the Cass County Jail where he was banging on the door and telling guards he was going to kill them
-Defense says the video wasn't part of discovery and they needed time to review it
-We took a short break and then when we got back the defense objected to its relevance and said it would be prejudicial
-We then took another break so Judge Gull could watch the video in her chambers
-She agreed with the defense and chose not to allow it
-Started this morning by playing phone calls Richard Allen made while in prison to his family
-Master Trooper Brian Harshman testified that he listened to more than 700 of Richard Allen’s calls
#DelphiTrial
-In a call on November 14, 2020 with his wife, Allen said to his wife that if it ever became too much for her than he’ll call the detectives and tell them whatever they want to know
-Allen’s wife was in the courtroom and began crying and put her head down
-Next was call to his mom on April 2, 2023 where he speaks about finding God and says the Lord Jesus Christ is his savior
-Then a call with his wife from April 3, 2023 was played where Allen said “I killed Abby and Libby”
-His wife says “no you didn’t” and he says “yes I did”
We picked back up with Defense Attorney Brad Rozzi's cross examination of Dr. Monica Wala who was the psychologist at Westville Correctional Facility where Allen was held in solitary confinement for more than a year
-Rozzi asked Dr. Wala about the clothing Allen was forced to wear while on suicide watch which was similar to a Kimono and apparently referred to as a "flintstone gown"
-Dr. Wala testified that the area where she and Allen had their sessions was not a therapeutic setting
-It was revealed that Mr. Allen was institutionalized sometime in 2019
-Went through several of Dr. Wala's reports from the early days of Allen at Westville where he was being called a "baby killer" by other inmates
-Allen also said he was being treated as if he is already guilty
-Only witness to take the stand so far is Dr. Monica Wala who was the psychologist at the Westville Correctional Facility
-Dr. Wala testified about her sessions and interactions with Mr. Allen
-Those included confessions he made to her about killing Abby and Libby
-At one point in early April he said he took their lives to preserve his own
-Allen also apparently admitted to have a sex addiction and was an alcoholic
-Dr. Wala said after Allen received discovery papers from his attorneys he began acting strangely
-She said repeatedly she believed it wasn't genuine and Allen was only doing odd things to get
-At one point Allen was apparently eating his own poop
-So far videos of both police interrogations have been played for the jury
-The first one was done by the prosecutors office investigator Steve Mullin and Sheriff Tony Liggett
-The second is with Lt. Jerry Holeman from state police
-First interrogation was done after Richard Allen’s tip to police was found
-They begin by asking him questions about what he did that day and where he parked at the trails
-They ask him about who he saw on the trails
-Allen said “There may have been someone on the bridge when I came back. I don’t really remember seeing anyone else that day. If I did, they didn’t jump out at me.”
-Things take a turn when they ask if they can examine his phone
-He initially agrees and gave them his passcode
-ISP Lt. Jerry Holeman took the stand again
-He is lead investigator for ISP on the case
-Prosecutor Nicholas McLeland asked him about the interrogation he did with Richard Allen on October 26, 2022
-This would be Allen's 2nd interview with police and was done after the warrant was served at his home
-Allen and his wife came to the Lafayette Post in order to get his car back after it had been seized
-Holeman said Allen was free to leave at any time
-During the interview, Allen told Holeman he shot his Sig Sauer gun often
-Allen said he never carried the gun unless he was fishing or mushroom hunting
-This interview was after his gun was linked to bullet at the crime scene
-Holeman said Allen had no explanation for that
