Trump has issued an Executive Order that revives his Muslim Ban but is also much much worse. Here’s a thread on key aspects of the new ban /1 whitehouse.gov/presidential-a…
The admin has clearly learned from its earlier efforts 2 ban natls from Muslim maj countries by issuing a “facially neutral” order that appears 2 create a non-arbitrary process 4 its various action items. This is procedural process washing of what it still a discriminatory ban /2
The new ban has many troubling provisions the old versions of the ban didn’t have, like this provision Image
Together these provisions suggest that foreign nationals from countries subject to the new ban that was admitted to the US in the last 4 yrs could be subject to deportation. Is this a blanket, automatic deportation order? /3
Or is it more particularized? Hard to provide answers since this provision is written in a deliberately vague way. Either way, it places countless foreign nationals present in the US in a precarious position - including over 40,000 Iranians holding non-visitor visas /4
One of my smart immigration colleagues has pointed out that the authority for this ban - 212(f) - creates some hurdles to treating this as a blanket deportation clause: hopefully he’s right /5
Then there’s this provision - which is also new Image
This seems quite clearly targeted to foreign nationals involved in pro-Palestine protests, in particular, foreign students on visas. Pro-Israel folks have been demanding the deportation of these protestors since Oct 7 /7newarab.com/news/will-dona…
Then there’s my personal favorite - a call to force foreign nationals to “assimilate” /8 Image
There is also a provision on refugees - as there was in previous versions of the Muslim
Ban. Don’t know off the top of my head whether this is any worse than those bans or current processes
for vetting asylum seekers. I believe the “stateless” lang is new, tho I could be wrong /9 Image
The stateless language will undoubtedly impact many Palestinians likely by design /10

1 last thing which others have also mentioned - 2(c) could also be the basis for a new-NSEERS like registry 4 foreign nationals already present in the US. NSEERS was a program started shortly after 9/11, req males of a certain age from almost only Muslim maj countries 2 register

1/ This is an extraordinary if obvious admission. It is obvious the reason Mangione is being charged with terrorism isnt because his alleged actions fit any plausible US legal definition of “terrorism.” It’s because of the outpouring of support for him across US society.
2/ It is because of how his purported anger/actions resonates with countless folks whose bodies are treated in cost-benefit terms rather than as precious living beings whose health and well-being are prioritized
3/ As with most if not all terrorism charges, the charge against Mangione is not only intended to distract from the actual political & economic grievances that likely drove his purported actions. It is also meant to render him evil, irrational, & beyond the pale.

1/ Having listened 2 this entire interview, I can say Rashid Khalid's comments abt Iran & the "Axis of Resistance" r inconsistent, imprecise & simplistic. Does Iran seek 2 promote its self-interest? Yes. Does that mean the Axis is pure real politik? No.
2/First, u could argue that the format here - a podcast interview - makes it unfair to hold Khalidi to a standard of precision or accuracy for an off-the-cuff cmt. His statements r pretty forceful tho & stated with a great confidence, so I think it's fair to hold him to them
3/ Second, Khalidi says that the Axis was not one of "resistance" but one of "deterrence" for Iran. At the same time, he claims that the non-state group members of the Axis are not Iranian puppets, that they are independent, but receive Iranian "support".

The House is set 2 vote on a bill that would allow the Trump admin 2 designate US non-profits, like universities, as "terrorist support orgs" if they, say, support pro-Palestine students protesting genocide. This bill is terrifying & must be stopped /n. /1theintercept.com/2024/11/10/tru…
The current bill incorporates another billl, HR 6408, which passed the House earlier this year but stalled in the Senate. That bill was exclusively aimed at stripping 501(c)(3) of their non-profit status for being "terrorist supporting orgs" /n
HR 6408 stalled in the Senate - because it is so terrifyingly broad w/massive implications for speech. Now, the House is reviving it in a new bill that pairs it with proposed legislation to give tax breaks to Americans imprisoned or taken hostage abroad. /n

As always, Heidi is right. Israel doesn't have any kind of right to respond to the strike against the Golan Heights, even if Hezbollah IS responsible. A bit more detail as to why coming at you now /n
One basis for responding is the right to self-defense under Art 51 (or a Sec Council res which isn’t going to happen). Israel has no Art 51 right since the Golan Heights is sovereign Syrian territory, NOT Israeli territory, as establish by intl law
Also unclear this rises to the level of an “armed attack”(req. to trigger Art 51) even if Hezbollah is responsible which it has uncharacteristically denied. & then there’s the whole mess abt whether the Art 51 rt even applies to non-state groups. The consensus is that it doesn’t
