After today's historic gold/silver win in Florida, members of the Texas House are attempting to have Texas surrender authority from Article 1 Section 10 of the Constitution to a federal court? Rep Geren's amendment 1 to HB 1056 would give away Texas sovereignty. Image
Why would Texas ever give up Constitutional authority to a federal court???? And this matter has been addressed by the Supreme Court of the United States already! Regarding the ability of a state to make Gold and Silver legal tender regarding Article 1, Section 10 of Constitution
Supreme Court already ruled on State authority to use gold/silver coins OR bullion. Quoting Lane County v. Oregon supreme.justia.com/cases/federal/…
"There is nothing in the Constitution which contemplates or authorizes any direct abridgment of this power by national legislation. To the extent just indicated, it is an complete in the states as the like power, within the limits of the Constitution, is complete in Congress...
If, therefore, the condition of any state, in the judgment of its legislature, requires the collection of taxes in kind -- that is to say by the delivery to the proper officers of a certain proportion of products, or in gold and silver bullion, or in gold and silver coin --
it is not easy to see upon what principle the national legislature can interfere with the exercise, to that end, of this power, original in the states and never as yet surrendered."
This literally says states CAN make gold and silver useful legal tender AND that right has never been surrendered. Geren's amendment seeks to surrender that right. His amendment is UNCONSTITUTIONAL! He tried it in State Affairs and was rejected.
Both Arkansas and Florida have passed this in their state. Governor Sanders signed it and Governor DeSantis promises to sign. WHY WOULD TEXAS GIVE UP STATE'S RIGHTS????? C'mon Texas! Do better!
Support bi-partisan HB 1056 as presented by Reps Dorazio, Raymond, Hunter, and Capriglione. Vote the bill out without Amendment 1.
