Attorney Bradl is here and he is speaking with two different police officers who are witness in this case.
If you're attending, the trial will be starting in Courtroom 1 the courtroom where we have had most other hearings in this case and then, I am told, we may be moving to another courtroom.
The lobby is full of Kearney and Karen Read supporters as I walked into the courtroom.
I saw Kearney heading in earlier. No sign of Lindsey Gaetani yet.
The court has allowed the public into the courtroom and they are instructing people to push together. The courtroom is full.

No idea how this is going to go, so standby.
They have called a different case to start. Kearney is here in the courtroom along with Bradl.

Bradl says they want a bench trial.
Further call. Case will be heard between 11 and 1 PM today and then finishing it up on Wednesday.

I'm going to head over to Norfolk Superior to see if I can get an alternate pass for Karen's case. BRB.
I talked to Aidan on the way out of court. I asked how he was doing and he said "great!" He seems relaxed. The lobby was full of supporters who left the courtroom to wait for the 11 AM call.
I am back over at Norfolk Superior. I checked in for an alternate media pass for the Karen Read trial. As of right now, there are FIVE press passes available. If at 10 AM, there are at least 3, I will be in.
I will cover Karen from 10 to 11 AM and then jump over cover the start of the Kearney trial.
Kearney told me he has also checked in for a press pass here and will come over when his hearing his done.
For those asking, Gaetani is on site at Dedham District.
And the Judge for Kearney's case is Pomerole.
I was stuck in traffic on the way in this morning and didn't realize until I got to the parking lot that I had been behind Paul O'Keefe the whole time. He drove in alone.
He has a sticker on the back of his car with John's badge number on it.

Scratch that: he is set up for a documentary, not the press. There is still no other press here except me.

There is a projection on the wall that looks like where a video is going to be played.
They are calling another case.
Case is being called.
First thing: An attorney for Paul OKeefe is here and the judge is hearing a motion to quash the testimony of Paul.
"24/7 it has become his occupation" Paul O'Keefe's attorney about POK being a victim in a case across the street.
Bradl: we believe there was a conspiracy between these witnesses.
Judge is asking about him having to make a decision on documents that Bradl is asking for.
Judge is saying that POK will most likely have to be here on Wednesday.
Motion to quash is DENIED.
Further review regarding documents will take place on Wednesday.
Okay, all done with that.
There are some motions filed by Cosgrove that are going to be heard here now.
Some of these are no longer applicable because there is no jury trial, but a bench trial.
Cosgrove does not want anyone from the public wearing things of support in the audience. Bradl does not object.
We have moved on to the next motion. I actually didn't hear it but Bradl is objecting.
I believe it has to do with the restraining order.
Nevermind, the motion, whatever it was, is allowed.
Next motion was allowed, whatever it was. I can barely hear Cosgrove.

Motion #8, Bradl says, will require a little explaination.
"We believe that Gaetani is a serial abuser of restraining orders." - Bradl
Bradl is talking about the video that I have previously shared showing Gaetani approaching her ex in a parking lot, where she got in his car, called the police and the ex was arrested.
Motion to play the video is ALLOWED.
We are starting the trial.
Cosgrove is starting with his opening statements.
He starts by saying this is a clear case.
Gaetani was meeting some individuals to attend a Karen Read hearing. Cosgrove says Gaetani was with members of the O'Keefe family.
Cosgrove says Kearney is a "YouTube personality" and Journalist.....he raises his hands in quotation marks as he says "journalist"
Cosgrove is saying that Gaetani forgot to mention the RO to the cop on site that day, the cop failed to mention it, so she later called the police and filed a complaint.
Bradl is up.
Bradl says that others enlisted Gaetani to get Kearney on a violation of the RO.
Bradl says Gaetani was waving a copy of the RO in court that day.
"Gaetani was there to flush out Kearney for the McCabes and O'Keefes" from the hearing, which was the first hearing Kearney could attend after he was released from jail just a few days before.
Meredith O'Neil will be the first witness today, Bradl says.
We are still in opening statements. Bradl is walking through each part of events the morning the alleged violation happened.
"This isn't incidental contact. This isn't accidental contact. This is NO contact" Bradl on the events of that day.
Bradl says this was manufactured contact after the fact.
Bradl has taken a very complicated set of events and broken it down in a way that was easy to understand.

Cosgrove is calling his first witness.

We are back in session. Cosgrove calls his first witness:
Paul Delano, who works for the Massachusetts Trial Court at Norfolk Superior.
We are looking at a photo of the front door/entry of the Norfolk Superior Courthouse. It is being projected on to the wall. No fancy screens in here.
We have gotten through the basic setup of the courthouse in question.
Delano is not familiar with Gaetani. He doesn't know what she looks like.
Delano is stating that he observed Kearney leave the courtroom when an individual walked in.
Cosgrove is done. Bradl is up.
Delano says he was first asked by the CW just a couple of months ago about his observations in this case, a year after the fact.
We are going to see a video from FOX news on the day of the hearing.
Fun fact: I was here in the courtroom that day. I observed all of the events that are being described in this case.

I can hear Cosgrove defending his questioning.

The judge has occasionally moved the questioning forward. He discouraged the witness from elaborating at one point.

Dunn was asked just a week ago to recall her observations on the day in question.
This is the first time she was asked by the Commonwealth about this event.
The witness recalls that Kearney came in to the courtroom AFTER Gaetani.
Bradl says we're just going to leave it at that.
Dunn is saying she doesn't know who Lindsey Gaetani sat with when she entered the courtroom.
I feel like raising my hand and saying I did.
A question from the Defense could have been if the witness knows that the Read family and the O'Keefe families sit on different sides of the courtroom.

The next witness for the Commonwealth is Meaghan Mallon.
She is the sister of Matt McCabe.
Mallon testified that she met Lindsey Gaetani for the first time the day in question.
Side note: For those of you watching both, the motion for a mistrial in the Karen Read case was just denied.
When asked how she knows Kearney, Mallon says "that is a loaded question."
She goes on to say that she knows him from his coverage of the Read trial and his harassment of her family.

Mallon says she turned her phone on to record as she exited the courthouse.
Mallon says she observed damage to Gaetani's car, although she can not describe it today other than maybe a key mark.

I'm waiting outside for Bradl and Kearney but everyone is waiting for Read heading to lunch.

BREAKING: Another Massachusetts illegal migrant charged with raping his daughter.
Lorenzo Lopez Alcario charged with rape of a child with force, aggravated, victim tied, bound, or gagged.
Sources tell me Alcario blindfolded his 8 year old daughter and raped her. Alcario allegedly recorded the rape and the mother of the child found the video and turned him in.
Alcario is set to be arraigned in Marlborough district court as we speak.
