[Before the jury in]
Judge Subramanian: I am ruling that the Government cannot recall Doctor Hughes for more testimony despite the Second Circuit's decision in US v. Larry Ray
[Book on Ray / Sarah Lawrence College sex cult case: amazon.com/gp/product/B09…
Judge Subramanian: On rule that Jane's notes reflecting alleged fraud to induce her into the hotel nights are admissible, despite the defense's arguments
[US reply about inducement: patreon.com/posts/diddy-do…
Combs' Alexandra Shapiro: Ms. Bongolan said clearly the balcony incident took place on September 26. We believed she perjured herself and that they knew. The government elicited that all injured were at the same time
Judge: Couldn't we just say that the Government screwed up, giving Ms. Westmoreland a rare Perry Mason moment in Federal court, that Defense back in its war zone could say, Great job?
Combs' Shapiro: She did do a great job. But they had Ms. Ventura say she saw it
Combs' Shapiro: This is only our second motion for a mistrial, I'm not sure why the Government says it's the third.
AUSA: Perjury is only one prong of a four part test.
Judge: This happened years ago, Ms. Bongolan was taken a lot of drugs, thank God she's sober
AUSA: Mr. Steel also moved for a mistrial
Judge: Well, he said he was going to move...
Combs' Shapiro: We object to Juror 6 being stricken, it's under seal but--
Judge: Everyone will be heard
[Where? Inner City Press filed: storage.courtlistener.com/recap/gov.usco…
Judge: Bring in Jane, then the jury...
All rise!
Judge: Ms. Geragos, you may proceed with cross examination.
Combs' Geragos: Jane, we met before - then you stopped meeting with the defense, that was your choice, right?
Jane: Correct
Combs' Geragos: You are testifying against Mr. Combs -
Jane: I'm testifying against him?
Geragos: How many times did they prep you on how to be cross examined at this trial?
Jane: Maybe 2 or 3 times.
Geragos: Did you bring in other prosecutors to cross you?
Yes
Combs' Geragos: And they granted you immunity at the grand jury, right?
Jane: Yes.
Geragos: You said you had regret about some of the choices you made with Mr. Combs?
Jane: If you have it, I'd love to look at it with you.
Combs' Geragos: You choice to participate in that lifestyle for many years - and you did not want to break up with him, right?
Jane: I did not want to.
Geragos: You had sex with other men for years
Jane: I resent the emotional control. I was hooked from the start
Jane: There was pressure to perform these acts my lover desired-
Combs' Geragos: You used the word partner again & again on direct, he was your partner?
Jane: Yes.
Geragos: You said you've having trouble answering for yourself why you had sex with these men?
Yes
Combs' Geragos: You are in therapy now?
Jane: Yes.
Geragos: You love Mr. Combs?
Jane: I love to spend time with my partner.
Geragos: You wanted to cuddle with him?
Jane: To give him foot rubs. You said-
AUSA Comey: Objection to counsel making herself a witness
Jane: I love to bathe him and we watch his favorite show
Combs' Geragos: Which show was that?
Jane: Dateline.
Geragos: Did you believe he was not doing this with anyone else?
Jane: During this time period.
Geragos: You'd look at his messages?
Jane: Yes
Jane: He was vulnerable in those hotel rooms and I share that with him. It was conflicting. I was breaking all my boundaries so that he would feel loved.
Combs Geragos: This brought you two together?
Jane: Yes. The lovemaking afterwards. That's why I enjoyed it
Combs' Geragos: You tried to be very sexy to him in those rooms?
Jane: I think I was sexy in those rooms.
Combs' Geragos: Because you are a beautiful woman. Did you choose the wardrobe?
Jane: Initially he did
Geragos: He liked baby oil, it turned him on?
Jane: Yes
Combs' Geragos: How old were you when you started your relationship with Mr. Combs?
Jane: 35.
Geragos: What are examples of your fantasy talk in those rooms?
Jane: He would have me and the entertainer be in a role play. Cheating role play, that Sean left town
Combs' Geragos: How high were your heels?
Jane: Six to seven inches. Usually I wear three to four inch heels.
Geragos: You wanted your child to be closer to your child's father - but did the father see the child?
Jane: What does that have to do with this?
Combs' Geragos: Who you fly weekly to Miami to see Mr. Combs?
Jane: Sometimes.
Geragos: We listed to 5 voice notes in which Mr. Combs sounded angry - but he'd sent you thousands, right?
Jane: Yes.
Geragos: Why did you feel he was larger that life?
A: Bright light
Jane: He introduced me to the Gospel. He had a favorite pastor, he'd watch on TV.
Combs' Geragos: Has that stayed with you?
Jane: Yes
Geragos: Do you watch that pastor today?
Objection
Sustained
Combs' Geragos: How much did he invest in your dress line?
A: $20,000
Combs' Geragos: Why did you join OnlyFans?
Jane: If I could get off it, I would. Financial need.
Geragos: Mr. Combs gave you money throughout the relationship - in three and a half years does $150,000 sound right?
Jane: I would assume.
Combs' Geragos: You told the government you gravitate toward providers?
Jane: Yes. As a woman I like that.
Geragos: You called the house, Our house.
Jane: Later I saw it as My house.
Combs' Geragos: You thought it was important that his staff not know about the entertainers, right?
AUSA: Objection!
Judge: Overruled
Jane: Right
Geragos: And that's a reason you go the house - that and a yard for your son?
Jane: Can you say, My child?

[Note - Inner City Press went to the courtroom at 8:30 am to speak on unsealing - it didn't happen until 9:10 am, but the unsealing order has been expanded (to demonstrative exhibits as well) and sped up to 24 hours) - now the first witness
All rise!
Groetzinger
AUSA: Where do you work?
Groetzinger: SeatGeek. Founded it in 2010, we saw a broken market. Going to a game is great, but buying the ticket, terrible. So we undertook to improve it.
AUSA: How do you get clients?
Groetzinger: We - and I - speak a year or more

Before the jury is brought in
Courtroom deputy: On sealing, you now longer have to say out loud when we are not showing exhibits [! we'll see what this means, how request to unseal is ruled on]
All rise!
Judge Subramanian: Tell me about PX 198
AUSA Seana Buzbee: The text involves our 2d witness today, Oliver Chi of the City of Irvine
Judge: Is that a new witness?
AUSA Dalhquist: We have travel issues. Mr. Chi will go between Mr. Geiger and Mr. Hurwitz [so no SeatGeek today?]

Judge Subramanian: Call your first witness.
AUSA Arianna Markel: We call John Abbamondi.
[Witness is sworn]
Markel: Where have you worked?
Abbamondi: St. Louis Cardinals and Padres; I worked on dynamic pricing. Then with the NBA
AUSA Markel: How many NBA teams use Ticketmaster?
Abbamondi: I'd say 25 out of 30. Then I went to MSG, corporate hospitality and suites. I led our sales team for our non sponsorship assets. Anything you could sit in, I sold it. I used Ticketmaster

9:29 am
Opening arguments still haven't begun.
Counsel: We intend to play a clip of Michael Rapino in our opening.
Judge Subramanian: Why? Both of these opening statement decks are more like argumentative closing argument decks. It's hard to address objections
10:02 am - while the parties re-jigger their demonstratives for opening statements,
Courtroom deputy Hernandez: In the gallery here in 23B do I have a Bolano? Bolano?
[Seems so]
Deputy: I will come right over

OK - now US v. Live Nation jury selection.
10:12 am
All rise!
Judge Subramanian: Glad you see you, prospective jurors. This is US et al versus Live Nation, there are parties on the US side.
Inner City Press will live tweet this, and the trial. Thread below.
Judge Subramanian: I know this jury service will be a hardship. During the trial you will have a half hour lunch, we will give you bagels and coffees from the courthouse cafeteria. This still could take six weeks...
Judge Subramanian: We have to avoid bias. So I will be asking you about your personal history and views, for an unbiased jury. I am not trying to pry. From you answers, I will be able to determine if you should be excused for cause. There will be peremptories

OK - now at US v Live Nation final final pre-trial conference. Inner City Press is covering the case innercitypress.com/sdny8asubraman… and will live tweet, thread below x.com/innercitypress…
Judge Subramanian: I rule that each side will have 65 hours. If I raise that, each side will get the same time. We have identified 79 jurors to come back. If we can't qualify 20 of them, we may reduce from 12 jurors, or I'll take back strikes.
Judge Subramanian: There's been a question raised about the potential jurors' experience with Live Nation or TicketMaster - they may feel they are awarding damages based on this experience. Plaintiffs' says there is no showing of bias.
