CJI: the HC has proceeded further to hear the matter . Time and again we are saying that the SC exercise its power on the judicial side...we emphasis that both HC and SC are the organs of the constitution. However, when the HC knows that SC is seized of the matter
CJI: the approach of the HC in proceeding in the petition and pass an order is not in tune with the scheme under which the constitutional courts functions. There is a stay of the proceedings before the HC and stay on the impugned order

Yesterday, the Court referred to S.21(3) of Representation of the People Act, 1950 and asked the petitioners whether ECI does not have residual power to conduct such an exercise in a "manner it deemed fit".

Telangana MLC Nominations | #SupremeCourt modifies its interim order dated August 14, 2024 that stayed the judgement of the High Court quashing the recommendation and nomination of Konda Ram and Amer Ali.
The Court deleted the sentence ordering a stay on the impugned judgement.
In that order, the Court had also stated that the nomination of the members will be subject to the outcome of the present petition challenging the High Court judgement.
