#CalcuttaHighCourt will hear a plea by the #ED alleging interference by CM @MamataOfficial during raids at the offices of the @IndianPAC pertaining to a 2020 coal scam.

The agency alleges that the CM took away important documents while the raid was ongoing.

@dir_ed Image @AITCofficial has also filed a plea stating that the #ED took away election-related documents from the offices of the poll consultants who are advising the state’s ruling party on strategy for the upcoming Bengal assembly elections.

#SupremeCour to continue hearing habeas corpus petition filed by Dr Gitanjali Angmo (@GitanjaliAngmo) seeking to illegal the detention of Ladakhi social activist and her husband #sonamwangchuk (@Wangchuk66) detention under the National Security Act as illegal.

Wangchuk was arrested after the #Protest for #statehood turned violent.

Sibal has so far argued

1. all materials on which detention is based not furnished, especially the 4 videos and therefore right to effective representation violated

2. materials referred in detention order is irrelevant as some of it dates back to 2024 but detaining authority is arguing that if those materials are discarded, the detention will be deemed to be based on other grounds as per S. 5A of NSA- sibal argues S. 5A does not apply in this case

3. District Magistrate, who issued the detention order, did not apply his mind and copy pasted the grounds of the SSP, which suggested the detention whereas, the law requires due satisfication of the authority.

Under Article 124(5), for a removal of judge, we have to follow the procedure established by 1968 Judges Inquiry Act- motion moved by 50MPs in RS/100 in Lok Sabha for removal of judge. 50 MPs will sign the motion. It can be a simple letter signed by 50 MPs or 100 MPs that he should be impeached.

Once motion is admitted, committee is formed and then it proceed like a departmental inquiry. Once report is given, the House debates. One peculiarity- once motion is moved in both houses on the same day- 21 July- two motions were moved in both houses seeking impeachment. Once motion is moved in both Houses on same day, this pecularity- the fulcrum of this case is-please come to judges inquiry act.
