Last month, CPUSA quietly amended their constitution to remove the requirement of leadership to ABIDE BY MAJORITY VOTES.
Not only that, they likely made the amendment illegally, with the illegitimate National Committee circumventing the constitutional requirements to amend the constitution.
EVEN FURTHER, they have DELETED the VERY CONSTITUTIONAL STATUTE used by rank-and-file members and local leaders to contest the lack of democracy at last year’s 32nd Convention, before they went on to reconstitute the ACP.
In other words, the leading pro-Democrat clique is further entrenching their illegal control over the party, and going so far as to change the constitution to pretend they’ve done nothing wrong.

Rank and file members referenced THIS SPECIFIC LANGUAGE to dispute the handling of Resolution 5 at CPUSA’s 32nd National Convention in 2024, and the internal struggle around this dispute is what ultimately led to the reconstitution of CPUSA as the American Communist Party @ACPMain.

For those unaware, Resolution 5 proposed that CPUSA continue its status quo policy of providing material support to Democratic Party electoral campaigns. CPUSA leadership apparently expected this resolution to be approved without significant opposition, but many convention delegates could not stomach a continuation of that policy in the face of the ongoing Gaza genocide.
When the voice vote for Resolution 5 was held, even supporters of the resolution said it “sounded like 50-50.” In other words, NO DEFINITIVE MAJORITY was established.
At past conventions, delegates’ raised convention passes were counted to establish a majority for contested resolutions. At the 2024 convention, however, it was announced that the resolution would instead be referred to the incoming national leadership for a decision — a group conveniently hand-picked by (and largely the same as) the outgoing national leadership.
Members were shocked at this announcement as the CPUSA constitution CLEARLY STATES:
“The National Convention is the leading body of the Party” (Article II, Section 2) and “The highest authority of the Party is the National Convention” (Article VI, Section 1).
How could the constitutional mandate of the highest party authority be overruled by convention procedures enacted by party leadership? (Procedures which were themselves enacted in complete disregard of properly-voiced objections by delegates — remember, I was there).
This was the issue the COMRADELY PETITION raised, calling to carry out the party procedures for a special National Convention so that a counted vote on Resolution 5 could be held.
Instead of acknowledging the error or responding to the arguments made in the petition, CPUSA leadership embarked on a witch hunt against any clubs or members who voiced questions about the handling of Resolution 5. These expelled members would go on to form the core of the reconstituted American Communist Party (@ACPMain)

Now, CPUSA leadership has FINALLY FORMALLY ACKNOWLEDGED that the arguments made were founded in a correct interpretation of the party constitution, as they saw the need to remove the key language upon which those arguments relied.
In the past, even minor changes to the constitution would be carried out at the National Convention. At the very least, a two month discussion period among membership is mandated. CPUSA leadership decided neither was necessary in this case.

There can be absolutely no doubt at this point that CPUSA is completely controlled by the Sims clique without the barest pretense of Marxist-Leninist principles.

No — CPUSA is still presented by some as a legitimate Marxist-Leninist party with credulous acceptance of their absurdly exaggerated membership claims. CPUSA uses their MILLIONS of $ in legacy assets to perpetuate this impression.
As a result, naive, newly-radicalized individuals still find their way into that organization where their energy and enthusiasm is then siphoned off and redirected back into the Democratic Party establishment.
People deserve to know the truth, and they deserve a Communist Party where their collective efforts will be used to wage struggle against the ruling class instead of propping it up.
They deserve @ACPMain.
