The trouble they are having is that even if the roommate is trans, and even if the roommate was in a relationship with the shooter - that doesn't prove it was a hate crime based motivation.
Especially when its the potential trans person that is cooperating.

If they elevate this to a federal crime on a "hate crime" charge they must prove not just the killing, but the hate crime motivation *BEYOND A SHADOW OF A DOUBT*
And if they can only prove the killing part, then the hate crime charge doesn't stick.

There is no regular "murder" charge federally, that's a state crime unless it meets specific conditions.
