Many believe Gavin Newsom's Prop 50 complies with the Constitution because it allows a public vote. This is a dangerous misunderstanding.
We live in a constitutional republic, not a pure democracy. #NoOn50
In a republic, the Constitution limits government power, regardless of majority votes. The Bill of Rights and amendments like the 14th and 15th protect individual and minority rights against majority tyranny.
Prop 50 is presented as the people's will, but Gavin's plan uses majority votes to override minority rights. A 51% agreement doesn't ensure it's right or constitutional.
I am tired of hearing that CA is redistricting to combat President Trump and TX redistricting efforts. Texas was forced to redistrict because the Biden DOJ sued Galveston County and lost which changed the law thus making 4 TX Congressional Districts unconstitutional. 🧵
2. When Texas drew its congressional districts in 2021, they created 4 congressional districts where they combined two minority communities to create a minority-majority district (Coalition minority districts). (Example, Congressional District 18).
3. On March 24, 2022, The Biden DOJ sued Galveston County Commissioners because Galveston did not draw a coalition minority district for the Black and Latino population.
Just filed a lawsuit asking the California Supreme Court to stop the special election currently scheduled for November 4th because the California legislature and Gavin Newsom violated the California Constitution in putting this ballot imitative on the ballot. 🧵
2/8 We argue that there is plenty of California Supreme Court precedent where the Court has removed unconstitutional ballot initiatives because "Voter consent cannot convert an unconstitutional [statute] into a constitutional one."
3/8 This redistricting ballot initiative is unconstitutional because it asks voters to vote on two separate issues.
1⃣ Voters are asked to encourage Congress to pass a U.S. Constitutional Amendment to require all states to have nonpartisan redistricting commissions for Congress.
2⃣ Voters are also asked to support the California's legislature's new maps that disregard the hard work of the citizen commission.
There are many voters in California who want to vote yes to the first question and no to the second question but they will not be allowed to split their vote.
This ballot initiative violates the single subject rule.
California's Constitution mandates that Congressional districts "shall be drawn to encourage geographical compactness such that nearby areas of population are not bypassed for more distant population."

1st a court ruled that courts can't sanction a church for refusing to shut down since it was later determined that Newsom overstepped his constitutional authority in shutting down churches.
