United States v. Comey

Defense files in opposition to prosecution's motion for implementation of a filter team. Image
A filter team is needed for a set of evidence that was seized per search warrant from one of Comey's attorneys as part of the Arctic Haze investigation.

You may remember we got a bunch of declassified memos on that investigation and ~half dozen others over the summer.
Arctic Haze was focused on finding who leaked classified information to the NYT, specifically the information that appeared in this April 2017 article. Image
The classified information that appeared in that article related to the Renteria Memo and the Russian Reports. Durham's Classified Annex focused on this subject and was declassified this summer. Image
The seized material that the filter team is needed for is currently "quarantined" from the prosecution and defense. The filter team would be used to screen it for material that may be potentially atty-client privileged. Image
Which all or most of it is going to be privileged, or initially claimed to be, because it's communications between Comey and his lawyer.

That lawyer, most likely, is Person 3 in the indictment in this case. Image

As part of the Arctic Haze investigation, Comey provided his iphone to the FBI.

On it were: four voicemail messages, four instant messages, two email messages, and 51 images from December 1, 2016 to May 1, 2017.

Defense wants the Gov't's motion for a filter team denied, but without predudice.

They don't oppose the filter protocol, they oppose implementing it before "the government identifies a valid legal basis for its search and fully discloses the scope of the materials it seeks to review."Image
That's consistent with what they told prosecutors about two weeks ago.

And that's about we can know about them from this filing, because everything about them is redacted. Image

The redactions are precautionary, as the government designated some of this material as Protected.

But "defense sees no reason why this information cannot be made public."

So maybe we will get these lifted soon. Image
The search warrants appear to be against Richman (Person 3) and covered from... 2016 to 2019? That's how I read it.

A filter team previously went through the material and Richman was involved (given the opportunity to assert privilege) but Comey was not part of that.

Prosecutors haven't obtained search warrants in connection with this case, and they haven't sought authorization for "a search of the Arctic Haze materials for evidence of the two offenses with which Mr. Comey is charged." Image
See, this is another reason why my working theory regarding this case is that it is NOT about "getting Comey."

It's about getting at classified and sealed materials.

It's about the 1A Package, the Durham Memo, the stuff that is behind the redaction blocks in the declassified memos from this summer.

It's about ANOTHER case. Maybe the one being built in Florida.

Next part of the filing concisely restates what the filter protocol would be, tells us that defense requested copies of the search warrants but didn't get them, and advises that defense "stands ready to confer regarding the protocol" if prosecutors will first "identify to the defense the materials to be reviewed..."Image

Why wasn't this filter team done BEFORE they indicted Comey?

Looks like an investigation post indictment and using material from 5 years ago that failed to find any evidence of crime to charge Comey or Richman with. Image

New ORDER from Judge Currie, who's handling Defense's Motion to Dismiss the Indictment based on Unlawful Appointment of Halligan.

He instructs the gov't to file, "no later than Monday, November 3, 2025, at 5:00 pm, for in camera review, all documents relating to the [Halligan's] participation in the grand jury proceedings, along with complete grand jury transcripts."Image

In an announcement yesterday, the U.S. "Special Attorney" for NJ referred to an indictment against two individuals for a hack of the U.S. court systems, among other intrusions.

Is this the group responsible for the PACER hack?
The indictment and arrests were made alongside partners in U.K. law enforcement.

The individuals are members of the Scattered Spider hacking group.

A DOJ Press Release describes a complaint, filed in NJ, against one of the individuals—Thalha Jubair. Image
Jubair is a U.K. national and is charged "with conspiracies to commit computer fraud, wire fraud, and money laundering, in relation to at least 120 computer network intrusions and extortion involving 47 U.S. entities. The complaint alleges victims paid at least $115,000,000 in ransom payments."

In November 2023, Binance and its found plead guilty to money laundering, sanctions violations and other offenses.

They agreed to pay $4.3 billion and enter into a monitoring program under DoJ and Treasury. Image
The failures to comply with sanctions, banking regulations, and antimoney laundering practices resulted Binance handling financial transactions between “U.S. users and users in sanctioned jurisdictions such as Iran, Cuba, Syria, and Russian-occupied regions of Ukraine”.

Binance profited from these transactions, collecting $1.3bil in fees from US customers.Image

Comey plainly did not lie to Congress about his interactions with Mr. Richman.

The question from Cruz wasn't about Comey and Richman, it was about Comey and McCabe!

Nachmanoff quickly DENIES the prosecutor's motion to expedite a ruling on implementing a filter team protocol.

1) Defendants have yet to respond to the motion
2) Defendants have 14 days to do so as per local rules. Image
Nachmanoff also notes that DOJ has had years to address the issue it is now in a rush to resolve; the IG report as well as the Fitzgerald-Comey relationship and memo affair have been public knowledge since 2019; Fitzgerald didn't suddenly become Comey's defense counsel—he's been that since Sept 25Image
Interestingly, Nachmanoff lets us know some of what was under the redaction blocks in the defense's reply to the motion to expedite.

These were expected and may be highly consequential to the case. Could kill it. Image
I predicted the former would be a "hefty" filing thanks to the many words Trump, Kash, and others in the administration have repeatedly uttered against Comey in interviews, rallies, and posted on social media.

It is The filing is 51 pages plus almost 80 pages in exhibits.

Is it "more compelling than most" filings of this type? We'll have to read it to find out.

The latter filing I predicted would likely give some folks a "case of the cognitive dissonances."

That's because, on the one hand, people on the right like that such a motion worked against Special Counsel Jack Smith... but don't like that a similar effort was lodged against Alina Habba in New Jersey... and they no doubt wish for this one to fail here against Lindsey Halligan.

And you can reverse all that for people on the left.
