Second Superseding Indictment filed.

This new indictment makes a small edit to the mention of a co-conspirator (not charged in this case, likely cooperating) and adds four pages concerning forfeiture upon conviction. Image
The original superseding indictment named Nathan Baumann as the individual Alvarado PD gave commands to.

The second superseding indictment edits this to "a rioter."

Could be they are not 100% sure it was Baumann, as everyone was wearing "black bloc."

Or, maybe they don't want to articulate Baumann, who is uncharged, committing a crime of vandalism to govt property in a filing.Image

They all plead guilty to 18 USC 2339A—providing material support to terrorists.

Are these the first Antifa members to be convicted on terrorism-related charges?
The people who didn't take the plea deal are now part of the nine members named in the first and second superseding indictments.
With one exception, I think.

Daniel Rolando Sanchez Estrada was indicted for conspiracy to conceal and for concealing material connected to the Antifa cell.

He moved a box containing instructional material and propaganda to hide it from law enforcement.

His case is ongoing. I don't think he was part of the attack but was part of the cell or was connected to it.

Remember, this is the first time an Antifa group has been hit with terrorism charges, and the case could serve as a template for future cases against the violent Marxist group.

Some members have already reached plea agreements on the terrorism charge.

Looks like Brian J. Cole Jr. will spend Christmas in jail.

Prosecutors, at the request of defense counsel, filed a motion requesting a continuance of the detention hearing currently set for Dec 15 to Dec 30. Image
Defense needs more time to review discovery.
Prosecutors do not oppose.
Urge the court to set aside the Speedy Trial Act.
Cole Jr. is currently detained on the complaint.
He has not entered a plea.
