🚨 EXCLUSIVE: A Rhode Island federal judge is facing a judicial misconduct complaint over her handling of a DOJ investigation into transgender drugs and surgeries for minors.

The complaint, filed by a conservative watchdog, accuses U.S. District Judge Mary McElroy of making false and politically motivated attacks against DOJ lawyers before referring them for possible discipline.

Last July, DOJ issued administrative subpoenas to hospitals across the country seeking records related to transgender drugs and surgeries provided to minors.

According to court records, Rhode Island Hospital produced just a six-page document before an Aug. 7, 2025 compliance deadline and continued disputing the subpoena’s scope.
After nearly 10 months of negotiations, DOJ went to federal court in Texas on April 30, 2026, seeking to enforce the subpoena.

Rhode Island Hospital responded by filing suit in Rhode Island, where the case was assigned to Judge Mary McElroy.
On May 14, 2026, McElroy quashed the subpoena and sharply criticized DOJ attorneys, accusing them of “dishonorable conduct,” being “unworthy of trust,” and acting with “an improper purpose in bad faith.”

She later referred the attorneys for possible disciplinary review.
The complaint by @SecureUSA argues those accusations were based on a false premise—that DOJ had misled a Texas court about communications with the hospital.

The complaint asks the 1st Circuit to investigate whether McElroy’s conduct violated federal judicial ethics rules and crossed the line from judicial criticism into sanctionable misconduct.

Prosecution includes Molly Gaston and Thomas Windom.
The government proposes that the trial begin on Jan. 2, estimate it will take no longer than 4-6 weeks.

The defense proposes that trial begin April 2026.
