1) In another thread (not on my profile), someone said that it was legal to yell ‘fire!’ in a crowded theater. I said that it was not, actually, because you still cannot incite a crowd to riot. The person said that was dicta and not enforceable under the First Amendment. 2) I said that the case from which the quote originally came used it as dicta, yes, and had been partially overturned by a later case, but the later case still would not allow you to incite a riot.

1) Dominion has been granted partial summary judgment over Fox News in its defamation case, on 3 issues. Fox's motion for summary judgment was denied, on all issues raised. The court's opinion can be found here:
courts.delaware.gov/Opinions/Downl… 2) The first issue the court grants Dominion's motion on is the issue of falsity - whether the statements Fox made about Dominion (which Dominion separated into 4 subgroups) were true or false. court found that they were false.

1) When Republicans push the "abortion restriction" agenda, what they're really saying is that women c/n have bodily autonomy. That's not *just* about abortion. It's also about access to hysterectomies, oophorectomies, IUDs, birth control pills, & meds like methotrexate. 2) When I was in college, my early 20s, I had a massive hemmorhage from my uterus. I almost died, and was in the hospital for a week. The cause was a hormonal imbalance - too much estrogen, no progestin.

UPDATE:
1) I spoke with the UHC escalation department again this morning. They now confirm receipt of the paperwork submitted by my doc (surprise!). They claim to have received it on Monday of this week. They asked for additional info, which was rec'd Tuesday (yesterday). 2) So far, so good, right? Well, now for the general fuckery part. A PET scan is a covered service, as they confirmed yesterday, but if their doc doesn't think it's necessary, they can deny it *anyway*.

1) As you may recall, I finished my 5th & final round of chemotherapy on July 8, and have been semi-patiently waiting for the PET scan that will tell us if it worked or not ever since. The PET had been scheduled for tomorrow at 8 AM...until this evening, when... 2) I suddenly get a call from the facility saying the insurer has cancelled the exam & it will have to be rescheduled. Now, I already know that tomorrow's was the only appt available for the next 3 wks out, so that's unacceptable. I tried to call them back, but they were closed.

It’s not. It’s a civil tort. You can be sued in civil court for it, but unless you can prove very specific things, it’s not usually an economically viable lawsuit.

1) Physical therapy continues to kick my ass, but the therapist is cutting me back to just 1 session per week w/him (down from 3) + home program, citing progress made. :) 2) Objectively, there is certainly progress. I can walk further, unassisted, w/fewer rest stops. There are exercises I c/n do at the start, that I can do, now.

1) A new Grothman constituent email newsletter is out; as usual, he fails to understand the basics of the issue discussed. This time, it's Pell Grants (PGs). If you weren't aware, PGs are usually awarded only to full-time undergrad students who have *dire* financial need. 2) These are students who might have problems finishing the degree in the standard 4 year time-frame, b/c they also work & therefore take only the minimum of 12 credits per term needed to qualify for "full time." 1) People apparently cannot read, today. I never said anyone involved in 1/6 had, as yet, been charged with seditious conspiracy. I'm aware that they have not. 1) I once did a thread on terms related to hunger, re: whether long-term hunger should be referred to as “hunger,” “food insecurity,” or “long-term food insufficiency.” I favor the last term as the most precise, but the real problem isn’t what we call it. 2) The term doesn’t really matter, and isn’t going to become a policy plank. The real problem is that real people are really going without - without food, shelter, sufficiently warm clothing, essential medication and other basic healthcare, etc.
