@Ross28821353@emrazz When someone is mugged, the testimony of the victim may be all the evidence the crime took place. No DNA, no video, just an empty purse or wallet and an ID by the victim. When a victim says there was no consent to the criminal behavior, their word is evidence. 2/@Ross28821353@emrazz I’m 60 yo and been an attorney for almost 30 of those years. I have never, ever heard a LEO, attorney, or judge ask a mugging or car theft victim, are you sure you didn’t agree to hand over your cash/keys? Could the defendant have mistaken your lack of consent somehow? ...3/

@aldotcom I’m reading betw the lines but: the RO is in place for 2 yrs, she has custody, he’s at the house, maybe w/ her permission bc of the kids, he gets angry, charges and she shoots him.
By ‘letting’ him violate the RO, even if it is letting him see them curbside, /1@aldotcom is enough of a signal to the police/DA that she is waffling, and therefore, ‘not deserving’ of the prima facia presumption of self-defense. The fact she is obligated to rigidly enforce the RO, make her children watch Dad get hauled off bc he *only* wants to see them /2
