Subject: Urgent Complaint Regarding Violations of the American Convention on Human Rights and the Prohibition of Torture – Case of Jair Messias Bolsonaro

Dear Commissioners,

I respectfully submit this letter as a formal denunciation of serious human rights violations committed against former President Jair Messias Bolsonaro, arising from acts and decisions taken by Brazilian Supreme Court Justice Alexandre de Moraes.

The conduct described herein constitutes violations of binding international human rights treaties ratified by Brazil, including the American Convention on Human Rights, the Inter-American Convention to Prevent and Punish Torture, and the United Nations Convention against Torture.

I. Violations of the Right to Humane Treatment and Health

Article 5(1) and 5(2) of the American Convention on Human Rights (ACHR) guarantee that:

“Every person has the right to have his physical, mental, and moral integrity respected” and that
“No one shall be subjected to torture or to cruel, inhuman, or degrading punishment or treatment.”

Despite this obligation, Justice Alexandre de Moraes has disregarded independent medical reports issued by licensed civilian physicians, openly casting doubt on their conclusions without any medical expertise or counter-expertise of equal standing.

Most critically, he required a forensic assessment by the Federal Police, body without medical specialization to “confirm” the necessity of a surgical procedure already indicated by treating physicians. This act represents a judicial intrusion into medical autonomy and violates the principle that detainees retain the full right to health and medical integrity, as consistently affirmed by the IACHR.

II. Denial of Adequate Post-Operative Recovery Conditions

Medical recommendations expressly indicated the need for post-operative recovery in a home environment. Nonetheless, Justice Moraes denied home confinement, asserting—without medical basis—that recovery within a custodial facility would be equivalent.

This position directly contravenes:
•Article 26 of the ACHR (progressive realization of economic, social, and cultural rights, including health);
•Principle X of the UN Body of Principles for the Protection of All Persons under Any Form of Detention or Imprisonment, which guarantees proper medical care;
•Rule 24 and Rule 27 of the UN Standard Minimum Rules for the Treatment of Prisoners (the Mandela Rules), which require clinically appropriate treatment and prohibit detention conditions that aggravate suffering.

A custodial environment is inherently unsuitable for post-surgical recovery due to infection risk, psychological stress, limited mobility, and lack of individualized care. Judicial insistence on such conditions constitutes medical neglect imposed by State authority.

•Action: Ordered preventive arrests and search-and-seizure operations against individuals such as former congressman Roberto Jefferson, journalist Allan dos Santos, and Bolsonaro-aligned businessmen in 2022, often without a prior formal complaint from the Public Prosecutor’s Office.
•Illegality Criticism: Critics argue that these measures lacked sufficient legal justification and violated due process (Article 5, LIV, of the Constitution). Preventive arrests should meet strict requirements, such as imminent risk, and should not be based solely on speculation or private messages without concrete evidence of criminal activity.

3. Torture of Mauro Cid During Interrogation
•Action: Mauro Cid, Bolsonaro’s former aide-de-camp, was allegedly subjected to coercion and psychological torture during interrogations by the Federal Police under orders from Moraes. Reports suggest that he was pressured to testify in a manner that aligned with the expectations of investigators and judicial authorities, even against his will.
•Illegality Criticism: The alleged coercion of testimonies under duress violates Article 5, III, of the Brazilian Constitution, which states that "no one shall be subjected to torture or to inhuman or degrading treatment". Such actions also violate international human rights agreements, making Moraes' involvement a direct violation of fundamental rights and abuse of power.

Essa semana aprendi um termo novo lendo um texto, em inglês,
sobre Ética.
O termo "areté" (ἀρετή) vem do grego antigo e traduz-se como "excelência"ou "virtude". Ele representa a idéia de alcançar o mais alto potencial, destacando-se em habilidade, caráter e virtude moral.
A minha pegunta para vocês hoje é: Qual o seu "areté"? + Qual a sua virtude? Qual a sua habilidade?

Isso me remete a julho de 2022, quando decidi abrir uma conta no, então,Twitter . O meu intuito era único, combater as mentiras da esquerda com a verdade, e assim ajudar o presidente Bolsonaro a se reeleger. Comecei como todo mundo, com zero seguidores, e não tive amigos ou familia para ajudar. Comecei em modo “incognito” para analisar o terreno perigoso que eu estava pisando, sem conhecer ninguém. Primeira pergunta que eu me fiz: Como eu posso ajudar? Quais as minhas habilidades?
Acredito que escrevo bem, poderia escrever cartas em inglês para os congressistas norte-americanos, e talvez para ONU, OEA, CIDH, TPI, etc, denunciando os abusos do TSE, e assim o fiz.
Formulei as cartas e disponiblizei no X, acredito que nesse momento eu não tivesse nem 100 seguidores. Muitas pessoas copiaram, e me disseram que tinham enviado para seus representantes aqui dos EUA.
O fato de ter poucos seguidores nunca foi uma barreira que impedisse qualquer das minha ações. +
