The case was not dismissed. The next hearing is December 10th.

⚠️ Tomorrow, the Court of Appeal will issue a decision on the next steps in the Tate case.

The Tate brothers and their PR team will likely spread misinformation about what is actually happening, as they have done many times in the past.

It’s possible they will even falsely claim the case has been dismissed.

👉🏼 WHAT IS ACTUALLY HAPPENING?

There was an irregularity found by the court. It is likely the indictment will be returned to DIICOT to fix the irregularity. They will be given 5 days to make the correction, and they will, as it’s not anything major.

👉🏼 WHAT IS THE IRREGULARITY?

The indictment did not clearly outline the exact amounts or assets the prosecutor wanted confiscated from each defendant for each alleged victim or interested party.

👉🏼 WHY IS THIS AN ISSUE?

Because this omission could impact the defendants’ ability to understand and contest what exactly the prosecutor seeks to confiscate.

👉🏼 ADDITIONAL INFORMATION

The court will also address some of Tate’s arguments. Additional requests could be made, causing further delays.

👉🏼 WILL A TRIAL DATE BE ANNOUNCED?

No. Regardless of tomorrow’s outcome, a separate hearing will determine the date of the trial if the Court of Appeal moves forward without additional delays.

1) The appeal is accepted, leading to further investigation.

2) The appeal is rejected, and the case goes to trial.

3) The case returns to court to document the reasoning for proceeding to trial.

LONG VERSION:

1) Appeal Accepted - Case sent back to DIICOT for further investigation.

This would delay the trial.

DIICOT would need to conduct further investigation, gather more evidence, or address specific issues raised by the court. DIICOT could then submit the case again for trial.

2) Appeal Rejected – Case goes directly to trial.

The Court of Appeal upholds the preliminary chamber court’s decision to send the case to trial.

This would mean the case proceeds to trial without further delay.

3) Case returned to court to document the reasoning for trial.

This is mostly an administrative / procedural step and doesn’t prevent the case from moving forward.

Once the court provides this reasoning, the case would proceed to trial as planned.

I’m going to make a few threads exposing disinformation from various Tate propaganda accounts.

1) On the day of their indictment, he told multiple media outlets the bros were not charged and DIICOT dropped most accusations. 🤡

2) There was no ‘false call’ to the embassy. A US marine thought an American citizen was in danger. That call led to the rescue of victims and kicked off a larger investigation.

CCTV footage from two locations are mentioned in the indictment and doesn’t disprove anything. 🤡

This is a heavily redacted (for privacy) and translated version of Tate’s indictment. It summarizes the charges and gives a general idea of why they were charged. It’s 14 pages.

The prosecutor has evidence of the accusations made here, and that evidence is summarized in the full 480 page (after translation) indictment.

Those summaries reference the various 75 volumes that make up their case files, and contain additional evidence and information, as I explained in yesterday’s space.

We plan to share that document once the trial starts, and sensitive information is fully redacted for everyone’s privacy.
