I want to FF a few years and move into the 80s with this thread because this is where the movement really got its legs again.

The evangelicals and fundamentalist were frustrated with SCOTUS rulings as well as Carter not supporting the pro-life cause. Their efforts to keep public schools segregated failed and when the IRS began investigating the tax status of these church/schools is when they became more active in politics. The more I think about the leaked opinion I am becoming more convinced that a law clerk who once worked with Thomas was the culprit. Why do I claim this? There are a few.

First, Thomas is the senior most justice on SCOTUS. The reporting suggests that Roberts was not in the majority which would leave Thomas to assign the opinion, instead Alito was chosen. Why would the most senior SCOTUS justice pass up the opinion of not only for it's historical significance, but would be THE opinion of his career? I can give you an idea.
