The Trump victory is devastating to abortion rights, but the movement will adjust & mitigate as much harm as possible. We know from both pre-Roe & post-Dobbs history (and other countries!) that banning abortion doesn't stop abortion. It changes it. We all thought Dobbs would 1/ decimate abortion access. But more abortions are happening now, often at lower cost, than before Dobbs thanks to a resilient movement that innovated (shield laws, telehealth, abortion funds, logistics coordinators). Of course, there are MANY tragedies & people left behind bc 2/

WHY do abortion bans impact miscarriage care when most states exclude "removal of a dead fetus" from the definition of abortion? Let me break it down for you: (1) For early miscarriages, death is hard to diagnose. Most miscarriages happen before the detection of fetal cardiac activity. So when someone goes to the doctor for bleeding in early pregnancy, how do docs determine death? Absence of cardiac activity is not yet diagnostic.

The most frustrating thing about Trump demonizing perinatal hospice is that perinatal hospice is THE antiabortion response to fetal anomalies. Antiabortion activists have been pushing these programs as an alternative to abortion for a least a decade. 1/3 Don't terminate a pregnancy affected by severe fetal anomaly, they say; instead, deliver the baby at term and use perinatal hospice. They have long argued that perinatal hospice allows women to grieve the pregnancy as "properly" as a mother, unlike abortion.

When @jillwieberlens & I wrote about how abortion bans are exposing the blurry line between abortion & pregnancy loss for @nytopinion, at least 5 conservative think pieces were written abt our op-ed arguing the line is clear. Here are some examples showing it isn't🧵 First & foremost, abortion is not a type of procedure or a medication -- the same procedures and medications used for abortion are also used for pregnancy loss. The question is whether those procedures and medications are initiated before the embryo / fetus has died on its own.

I’m thrilled to announce that @CornellLawReview will publish my article, Early Abortion Exceptionalism, which explores FDA’s harsh regulation of mifepristone, the only drug approved to terminate an early pregnancy. I am so grateful to everyone who helped me with this paper: Image First and foremost, thanks to @SLU_HealthLaw and @aslme for hosting the @HealthLawScholars program, which allowed me to meet and learn from such a supportive and impressive group of scholars: @profmohapatra, Fred Rottneck, @RobGatter, Jessie Goldner ...
