Okay, reading through the transcript from the Ticket/Dan&Jake hearing and it's pretty clear pretty early on why Cumulus lost and didn't receive a TRO @PhilipTKingston made a great point in his opening argument: Cumulus agreed to postpone the hearing for three weeks and allowed The Dumb Zone to continue broadcasting, then argued the existence of The Dumb Zone was an existential threat.
