Donald Trump's lawyers just warned Judge Chutkan in DC that if she releases Jack Smith's appendix to his recent report, they'll consider "litigation options."
Like, suing the judge? Or Smith? Or seeking dismissal of the entire case based on that release?
It's notable that the judge had to order the court clerk to put this on the public docket.
Trump's lawyers were directed to file this under seal. It seems like they did. But the judge must have thought, there's nothing secret here.

I'm outside the Manhattan appellate courthouse, where Donald Trump will try to overturn his half billion dollar bank fraud judgment.
My dispatches here and @NOTUSreports.
The inscription outside the courthouse says, "the written law is the traditional law."
Today's question is whether the law on the books, New York Executive Law § 63(12), can be leveraged against a businessman who lied about his wealth.

In a shocking and confounding move, New York Supreme Court Justice Juan Merchan has decided to delay Donald Trump's sentencing in Manhattan until after the November 5 election.
Here's why that is rife with problems.
(thread)

Merchan writes: "Unfortunately, we are now at a place and time that is fraught with complexities rendering the requirements of a sentencing hearing, should one be necessary, difficult to execute."
The judge shows that he is doubting whether Trump should even be sentenced.

I'm in DC federal court for Donald Trump's hearing--the first since Jack Smith's 2020 election interference case was put on hold in December 2023.
Catch my dispatches here. I'll be writing for @NOTUSreports.
@NOTUSreports Remember, this is the first time Judge Chutkan speaks up since the Supreme Court overturned her decision.
She had said Trump couldn't claim presidential immunity. SCOTUS gave it to him for "official acts."
Potential icy start to this morning's proceedings...

It's the 21st day of trial during the 22nd week of the year.
Manhattan's roads are brilliant as the sunlight pierces the city's east-west streets at a perfect angle.
Donald Trump is back in court on the day jurors could begin to decide his fate.
I'm here for @thedailybeast.
@thedailybeast After taking a full week off for the Memorial Day holiday, the trial is back on.
Defense lawyers and prosecutors will take turns delivering their last messages to jurors.

Day 20 of Donald Trump's trial. We're in the final stretch.
Prosecutors will cross-examine Robert Costello, aka "Backchannel Bob," the MAGA lawyer who tried to establish a covert comms line running from Michael Cohen to the Trump White House.
I'm in court for @thedailybeast:
@thedailybeast Last time on The Trump Trials...
The judge briefly ejected all journalists from his courtroom on Monday to reprimand Costello for challenging his authority.
The transcript, released that night, revealed what happened.
It's the 19th day of trial on the 20th day of May.
The DA will rest its case. Now it's Donald Trump's turn.
For all his bluster outside the court, will he remain silent within it?
The kitten fancies himself a lion. We'll see if he roars.
I'm here for @thedailybeast.
His loyal followers are already showing up. Former congressman Trey Gowdy just stepped into the line with journalists outside the courthouse.

Day 18. Donald Trump's lawyers get another chance to try locking this down and destroying Michael Cohen.
Last time, it didn't work. I'll be in the courtroom for @thedailybeast.
@thedailybeast The wannabe king has arrived, followed by his new batch of court jesters: Lauren Boebert, Matt Gaetz, Anna Paulina Luna.
Alas, those who toil hardest sometimes get overlooked. Despite his insurrection efforts, Andy Biggs got the worst seat in the room.
It's a wet and misty New York City on Day 12 of Donald Trump's criminal trial.
This is the start of week four, and it doesn't quite feel halfway done yet.
I'll be in the courtroom, as always. Full stories @thedailybeast.
@thedailybeast Last time on The Trump Trials...
his former PR guru cried on the stand, made Michael Cohen look bad, & gave prosecutors a tiny gem by solidifying the idea that Trump benefited from burying the Stormy Daniels scandal before the election.
It's Day 10 of Donald Trump's first criminal trial.
I'm at the Manhattan courthouse, where he's due to arrive soon.
So far, prosecutors have called witnesses who laid out the hush money deal. Now who can they present next to show jurors he called the shots?
Yesterday, the lawyer who worked on these deals came off as slimy, aloof, and untrustworthy.
I'm back in Manhattan criminal court today, where Donald Trump faces some $10,000 in fines for running his mouth during his Stormy Daniels trial.
I'll be updating here from the courtroom, where the ex-president will arrive soon.
Last time on The Trump Trials...
My colleague @JustinRohrlich reported how the DA's office tried to focus the jury's attention on the fact that Trump is paying for the lawyer repping his longtime executive assistant, Rhona Graff, who testified in court.
I'm back in court, where Donald Trump has sat down and we continue with jury selection. It very well could end today, at this pace.
Follow along, as I'll be updating for @thedailybeast
@thedailybeast The very first person to answer the questionnaire is a perfect example of the pressure here.
She cited a severe anxiety problem (takes meds for it) and said this case will make it work. Her friends/family know she's been on jury duty for a few days now & questions are swirling.

It's chilly & gray on Day 3 of Donald Trump's first criminal trial. I'm here for @thedailybeast.
I stand outside the Manhattan courthouse, waiting to see if the judge will reprimand him for angrily posting about jurors.
An altered version of Kipling's jungle poem seems fitting.
I'm sitting in the courtroom waiting for trial to start at 9:30.
Stay tuned for updates. Trump's behavior in the last 24 hours could spark a discussion this morning before jury selection continues.

Donald Trump's lawyers are in an Atlanta court right now.
They're arguing that DA Fani Willis' indictment should be dismissed because any of his lies about 2020 election fraud were merely free speech and somehow... helpful to uncovering the truth.
John Floyd, the RICO expert whom the DA hired to help her with this case, just stressed an interesting point.
Even if Trump's lies were actually true—and could be considered free speech—in actuality, he still took part in an overarching criminal conspiracy.

It's a frosty spring morning in Manhattan, where a judge will try to get to the bottom of the chaotic, last minute delays in Donald Trump's hush money trial.
I'll be reporting for @thedailybeast.
Here's the weird situation behind the delay.
Donald Trump quietly lined up a $91 million loan on Tuesday, and just revealed it today in federal court.
Now he can continue to appeal the $83 million verdict that came after he lost his second rape defamation trial against E. Jean Carroll.
Federal Insurance Company is based in NJ but operates in NY, where docs show it's regulated by NY's Dept of Financial Services.
Red flag? Trump's bank fraud trial judge recently barred him from borrowing at DFS-regulated lenders. But an appellate judge just put that on hold.
